Georgia Columbia County. To the clerk of the court of Ordinary. The Petition of Collier Foster sheweth that whereas George w. Bowdre has lately died xxxxxxxxxxxxxxx of a considerable estate both real and personal xxxxxxxxx of administration on said estate. This 10th. January 1821 Collier Foster. I DO solemnly swear, that George W. Bowdre deceased, died without any Will, as far as I know or believe, and that I will well and truly administer on all and singular the goods and chattels, rights and credits of the said deceased, and pay all his just debts as far as the same will extend, and the law requires me, and that I will make a true and perfect inventory of all and singular the goods and chattels, rights and credits, and a just return thereof, when thereunto required. - So help me God. Bealle & James Yarbrough are held and firmly bound to their Honors, the Judges of the Court of Ordinary for said County, and their successors in office, in the sum of fifteen hundred dollars to be paid to the said Judges or their successors, to which payment well and truly to be made and done, we bind ourselves, our heirs, executors, and administrators, in the whole and for the whole, jointly and severally, firmly by these presents. Sealed with our seals and dated this 12th. Day of February one thousand eight hundred and twenty one. THE CONDITION OF THE ABOVE OBLIGATION IS SUCH That if the bound Collier Foster administrator of the goods and chattels, rights and credits, of George W. Bowdre late of this county, deceased, do make a true and perfect inventory of all and singular the goods, chattels and credits of said deceased, which have or shall come to the hands or possession of the said Collier Foster or in the hands or possession of any other person or persons for him and the same, so made, do exhibit into the office of said Court of Ordinary when he shall be thereunto required, by the said Court of Ordinary when he shall be thereunto required, and such goods, chattels and credits do well and truly administer according to law, and do make a true and just account of his actings and doings when he shall be thereunto required, by the said Court of Ordinary for said county, and all the rest of the goods, chattels and credits, which shall be found remaining upon the account of the said administration, the same being first allowed of by said Court, shall deliver and pay to such person or persons, respectively, as are entitled to the same by law; and if it shall hereafter appear that any last will and testament was made by the said deceased, and the same be proved before said Court, and the executors obtain a certificate of the probate thereof, then the said Collier Foster do in such case, if required, render and deliver up the said letters of administration - then this obligation to be void. Bowdre deceased wheresoever any of the goods and chattels of said deceased are or do remain within the said xxxxx and which shall be shewn unto you by the said Collier Foster adm. and there view and appraise all and every the goods and chattels, being first sworn on the Holy xxxx of almighty God, to make a true and perfect inventory and appraisement thereof, and to cause the same to be returned under your hand or any three or more of you to the said admr. within three months from the date hereof. The petition of Collier Foster administrator of the Estate of George W. Bowdre late of said county deceased humbly sheweth that whereas there is one negroe woman by the name of Betty belonging to the Estate of said deceased and said negroe woman Betty cannot be divided among the xxxx of said Estate in kind and your Petitioner having given all the parties twenty days notice of such intent to petition, your Petitioner prays that this court may pass an order for the sale of said slave agreeable to the acts of assembly in that case made & provided and your petitioner will in duty bound ever pray. Smith, John Clutt, Stephen Lisles, & William L. Crawford Esquires. Whereas Hays Bowdre for himself and as guardian for Emily Bowdre & Elisa R. Bowdre and Collier Foster in right of his wife Lucinda and Thomas J. Bowdre the legal kins of George W. Bowdre decd. has applied by petition to the Honorable the Court of Ordinary for said County for an order for a writ of distribution to divide the personal estate of said deceased amongst the kins and representatives of said estate and of appearing to this Court such order ought to be granted. It is therefore ordered that you the said David Walker, Leonard B. Smith, John Clutt, Stephen Lisles & William L. Crawford or any three or more of you meet at some convenient time and place giving Collier Foster admr. due notice of your said meeting, & you the said Collier Foster administrator as aforesaid are hereby required to produce and lay before the said Commissions each and every the personal Estate that may be in your possession as administrator as aforesaid at the time and place so named by said Commissions, and you the said Commissions are hereby required to notify the heirs aforesaid of the time and place you may appoint to make said distribution to be present if they choose and then and there make Distribution of all and singular the personal Estate of said George W. Bowdre deceased which may be laid before you by said Administrator first taking & subscribing the Oath hereunto annexed in the following manner, to wit, one fifth part of said estate to Hays Bowdre, To Hays Bowdre as guardian of Emily Bowdre one fifth part, To Elisa R. Bowdre one fifth part, To Collier Foster in right of his wife Lucinda, late Lucinda Bowdre, one fifth part, and to Thomas J. Bowdre the remaining one fifth part, they being the kins and representatives of said Estate all which property to be held separately & in severally so that neither of the said heirs shall have more of the inheritance thereof than to them in right belongeth, and the Distribution or Partition by you to be made distinctly & openly by lot or otherwise under your hands and seals and have you before the judges of the Court of Ordinary in and for said County on the first Monday in March next, also this writ also naming the parties concerned agreeably to direction of said writ to be present if they see fit so to be, and after due and mature deliberation being had upon all and every the premises laid before us by virtue of said writ of distribution and the Statute in such cases made and providing we have distributed the said estate in the following manner that is to say - We do hereby assign and deliver over to Hayes Bowdre in cash one hundred and forty two 75/100 Dollars. We do hereby assign and deliver over to Hayes Bowdre as guardian of Emily Bowdre in cash one hundred and forty two 75/100 Dollars. We do hereby assign and deliver over to Elisa R. Bowdre in cash one hundred and forty two 75/100 Dollars. We do hereby assign and deliver over to Collier Foster in right of his wife Lucinda, late Lucinda Bowdre in cash one hundred and forty two 75/100 Dollars. We do hereby assign and deliver over to Thomas J. Bowdre in cash one hundred and forty two 75/100 Dollars. All which personal property which form aforesaid parting, dividing assigning and delivering are all the estate of George W. Bowdre deceased as shewn us by Collier Foster administrator on said estate - all which we certify to the Honorable Court of Ordinary for the County aforesaid within the time limited in the annexed writ.
