This file was contributed by: Pattie Causey pacausey@mindspring.com ==================================================================== HUMPHREY EVANS "Know all Men by these Presents that I Humphrey Evans of the County of Columbia and State of Georgia considering that I am old, and being anxious to settle my affairs during my lifetime do hereby make this my last Will and Testament, renouncing all former Wills made by me. Item 1st It is my Will that immediately after my decease all my just and lawful Debts be paid Item 2d. It is my Will that in the Event of my Wife surviving me all my property of every description both real and personal shall belong to her during her lifetime, and at her death to be disposed of as herein after directed Item 3d. I Give and bequeath to my Daughter Mrs. Prudence H. Chamberlain the following named Negroes Vizt. Reuben Tom Lewis Peg, and Rainey the same to belong to her in her own right and I farther Give to my said Daughter Prudence the Tract of land known as the Point - lying on, or adjacent to, Keg Creek and Savannah River, presently farmed by me, the same to belong to her the said Prudence H. Chamberlain also in her own right. Item 4th. I Give and bequeath to my Daughter Mrs. Jane Heggie the Tract of Land known as my Home tract upon which I presently reside and upon which my Dwelling house is situated the same to belong to her in her own right, excluding the jus marite of her husband. Item 5th. I desire that all my household furniture of every description be equally divided betwixt my two Daughters Mrs. Prudence H. Chamberlain and Mrs. Jane Heggie. Item 6th. All the residue of my property, including Negroes, horses, Mules, farming utensils, Notes, money, Cotton Bales, Corn Fodder, Sheep, and every other species of property presently belonging, or which shall belong to me at the time of my death I desire to be divided into four equal Lots and each Lot to be disposed of as follows. One Lot I Give to my said Daughter Prudence H. Chamberlain one Lot I Give and bequeath to my other Daughter Jane Heggie, and at her Death to go to her Children and I hereby nominate and appoint Lucius A. Luke to be trustee for her; one Lot I Give to the Children of my deceased Son John Evans, but the portion or Share accruing to Nancy Evans or Cartledge, Wife of Doctor James Cartledge to belong to her in her own right; excluding the jus marite of her said husband and I hereby nominate and appoint Major Henry Freeman of Lincoln County to be Trustee and Manager for said Property; and the remaining Lot I Give to the Children of my other deceased Son William Evans and Lucy M. Perry, who are five in number and at present living in Alabama, excluding the Children of his former marriage. Item 7th I hereby nominate and appoint Ambrose J. Avery my sole Executor to carry out the purposes of this my Will as herein expressed, knowing that he will do the same in good faith.
