IVEY "State of Georgia County of Columbia In the name of God Amen! I Eldridge P. Ivey of the County and State aforesaid, being of sound mind and disposing memory and feeling the infirmities of age, and well assured that I am to die, am desirous to dispose of the worldly goods with which a kind Providence has been pleased to bless me, To my wish & satisfaction, do this the Twenty sixth day of May in the year of our Lord One thousand eight hundred and forty five make, publish, and ordain this my last Will and Testament, annulling and revoking all others heretofore made by me of a previous date. Item the 1st It is my will and desire that my Executors hereinafter mentioned do pay all my just debts, as soon after my decease as may be practicable. Item the 2nd I give and bequeath unto my son Thomas I.? Ivey & his Heirs forever the following Property viz. Sam a negro man slave, Patrick a negro man slave, Ceasar a negro Boy slave and Mary, a negro woman Slave known as the one I puchased of Ivey Item the 3rd I give and bequeath unto my son Zebedee Ivey and his Heirs forever, Sixty Acres of Land lying in Warren County adjoining Lands of Juriah Harris and others, also the following negro Slaves Viz. George whom I purchased of Granade, Washington, bought of Dooly, Mary bought in Hamburg, and Judy a Girl Itme the 4th I give and bequeath unto my Son Elias Ivey his Heirs and assigns forever the following property, Viz. All that tract of Land lying situate and being in Columbia County, adjoining Pryer & Harrison, the same known as the Baldwin Place, containing Two hundred and ninety Acres more or less. also, the following negro slaves Viz. - Peter a man bought of Howard, Stephen, Albert and Amanda, also 100 Bushels of Corn, 300 lbs? of Pork, 1 yoke of Oxen, 2 Sows & Pigs, 2 Cows & Calves & One Bed & furniture. Item the 5th I give and bequeath unto my Son James M. Ivey his Heirs & assigns forever, the following property Viz. The Tract of Land whereon I now reside; adjoining Roberts & Mrs. Ross, containing Five hundred and seventy one Acres more or less, also the following negro Slaves Viz. - Ned, Sanders, Amos, and Milly, also 100 Bushels of Corn, 500 lbs? of Pork, 1 yoke of Oxen, 2 Sows & Pigs, 2 Cows and calves, & one Bed and furniture. Item the 6th I give unto my Two Grand Daughters Martha Ann Arnett and Elizabeth Irene Arnett, the Sum of Three hundred dollars each to be paid them by my Executors hereinafter mentioned, at their arriving at Twenty One years of age, said Sum to be free of any Interest that might accrue - Item the 7th I give and bequeath unto my son in Law Seaborn I.? Arnett who intermarried with my Daughter Elizabeth (now deceased) the Sum of Five dollars, which is all he is to receive from my Estate both Real & Personal - Item the 8th I wish it distinctly understood that in the event of any of the negroes (bequeathed in the foregoing Items) should decease before this my will is executed then in that event, that the amount in value be made up to such child or children out of my Estate unwilled, & further that the issue of the female slaves mentioned in the foregoing Items (if any) shall be thrown into my Estate unwilled & become a part and parcel of the same to be divided as hereinafter mentioned Item the 9th It is my will that all of my Property both Real and Personal, not mentioned in the foregoing Items and that is unwilled Shall be sold by my Executors & the proceeds of such sale to be equally divided between my Four Sons Thomas I.?, Zebedee, Elias & James M. Ivey share & share alike, my Executors first reserving the amount bequeathed heretofore as Cash Legacies Item the 10th In order to carry into effect this my last Will and Testament I do hereby nominate and appoint my Two sons Thomas I. & Zebedee Ivey my Lawful Executors In testimony whereof I have hereunto set my hand & affixed my seal that this day & year as above & afore written Eldridge P.
