Neal of the county and State aforsaid being advanced in years and knowing that all men must die having been blessed with a family and some property do make and ordain this my last will and testament. Item 1st I request that my executors pay all my just debts. Item 2nd I give unto my wife Sarah H. Neal four of the 1st choice of my horses, riding carriage Such of my Stock of all kinds as She may think necessary for carrying on the farm and so much of my other perishable property of all kinds & Sorts crop &c as may be deemed necessary and proper for keeping house and carying on the farm the balance to be Sold by my executors and applied as hreafter named (as Sales or Surpluses also I loan my wife Sarah during her life or until She may intermarry my Negro boy Nelson my Negro Woman Chaney and her Child Charlotte At her death to be equally divide among my children by her Item 3rd I give unto my five children by my present wife (viz) Sarah Jane, Amanda Ann, Basil Llewellen, Mariah Frances, & James Augustus, the following negros (viz) Nero, old Ben, Benny, Lucy, Rosetter, Caty, Abi, Dicy, Harry, Alcy, Milley, Jeffry Dennis, Charles, Caroline, old Aron & Marshall, with their future increase also all my landed property lying and being in the county of Columbia the Same being five hundred Acres more or less. All the moneys or notes I may possess at my death or may acrue after from crops Sales Surpluses &c over and above raising and educating them the property given them and what I may hereafter give them to be equally divided among them when the youngest become of age. I authorize my Executors to loan such property as they think can be spared to those that may marry before the youngest become of age I also give my two Sons heretofore named Basil Lewellin & James Augustus my tract of Land lying in Dooly County containing two hundred two & half ! Acres and my firearms The property give to my wife Sarah and my Children by her to be kept together on the farm whereon I now live by my executors for their mutual support raising and Education Item 4th I give unto my Daughter Eleanor Smally the Negros now in her possession as a loan (viz) Fanny, Frankey, Permelia, Smith, Jonas, Bassel and the infant children of Fanny & Frankey with their future increase to during her life as a gift or loan at her death to be equally divided among her Children (or their issue) Item 5th I give unto my deceased Daughter Elizebeth Dunns Children the negroes in the possession of Wm S. Dunn my Son in law as a loan (viz) Kitty, Rachel, Roda, Ann, Aggy Frances and the young children of Kitty with their future increase forever Item 6th I give unto my grand Son Jas. B. Neal the negros now in his possession viz Mahala John Isabel Ligon & Savannah with their future Increase to him and his heirs forever Item 7th I give unto my grand Son Richard S, Neal the negros in his possession (viz) Joseph Anderson Patsey, Hepses & young aggy with their future increase. also one bed and furniture & cow and calf to him & his heirs forever I also give unto my grand Sons James B. & Richard S, Neal my tract of land lying In paulding County containing forty Acres Item 8th The following negros I desire Shall be divided into two equal lots or Share (viz) Oliver, old Aggy, Jerry, young Ben, Elijah, Hiram, William, Easter, Joicy, Elliot?, Randle, Adam, old Mary, Solomon, Harriett, young Mary, Terry, Allen, Charity and Savanah (small numbers 1-20 written above these names) with their future increase one of the lots or Shares I give unto my five children by my present wife heretofore named The other lot or Share to be divided into four equal lots, one lot I give to my two grand Sons James B. Neal & Richard S, Neal, one lot to my Daughter Eleanor Smally, one lot to my deceased Daughter Elizebeth Dunns Children the fourth and last lot to my deceased Daughter Ann McCords Children 9th I give my Sons in laws James McCord John Livingston, William S. Dunn & daughter in law Dorothy Palmer one dollar each as their entire portion of my estate 10th Should my wife marry and remain with my children on the farm I wish her supported So long as She may remain with them 11th I request that no division of any kind take place until the ingethering of the growing crop Finally I constitute and appoint my wife Sarah H. Neal Excix and James B. & Richard S. Neal Execs to See this my last will and testament carried fully into effect In witness whereof I Basil O. Neal on 4 Dec 1848 separate: "In? the Court of Ordinary of Columbia County November Term 1848 And now at this Term came James B. Neal and Sarah N. Neal executor and executrix of the last will & testament of Basil O'Neal deceased late of said County and propon? for probate and ? the accompanying paper as the true last will & testament for the said Basil O'Neal, which they aver it to be - A.I. ? Miller Atty for said executor and executrix (writing below very hard to read) Now came at this time the will of Bazil O'Neal (in this paper name is written as O'Neal not Neal)being brought before the court for probate Michael Smally in right of his wife and William Spires in right of his wife Mary Spires, Ms N. McCord Bazil McCord Snow? Scuddy? in right of his wife Elizabeth Scuddy? Henry Potsford in right of his wife Nancy?, Elinor McCord, Simion McCord, grand children of said oneal, B.S. Dun? in right of his wife Annwood Wm G. Dunn Mary B. Dun Sarah C. Dun Waters B. Dun James B. Dunn Martha C. Dun grand children of the said Oneal and heirs at Law of the said Oneal comes and enters their caveat upon the following grounds 1st For that the said Bazil Neal at the time of making said pretended ? was not of sound and disposing mind and memory. 2d For that also the said Neal executed said pretended will from over importunities of the legatees named in said will 3rd For that also the mind & memory of the said Neal was exceedingly un? and weak and divers fraudulent practices were employed to induce him to make the unjust disposition of his estate as contained in said pretended will And of this said Caveator is ready to verify whereof we pray pred? of the court ?
