This file was contributed by: Cheryl Aultman cacbjeb@msn.com ==================================================================== WILL OF BARNETT WHITTINGTON Columbia Co, GA Will Book H, pg. 449-451 transcribed by Cheryl Aultman Barnett Whittington's Will, Registered 25th March 1819 Georgia In the name of God Amen, I Barnett Whittington of the County of Columbia and State aforesaid being weak in body but of sound mind and disposing memory and calling to mind the uncertainty of life and that it is appointed for all men once to die, I have therefore thought proper to dispose of the property which it has pleased the almighty to bless me with in manner & form following, to wit, First. I bequeath my soul to my maker who gave it me and my body to the grave to be entered ???? by and at the discretion of my executors herein after named. Second. It is my will and desire that all my just debts should be paid as soon after my death as my Executors conveniently can. Three. I give and bequeath to my beloved wife Sarah one negro woman named China and the future increase of China to be disposed of at the death of my wife as she may think proper. I also give and bequeath to my beloved wife Sarah one negro girl named Judy and her increase during her natural life. I give and bequeath to my daughter Elizabeth Barham one negro girl named Rhoda and her increase to her and her heirs forever. I give and bequeath to my son Ephraim his heirs and assigns forever one negro boy named Amos and one hundred dollars to be raised out of my Estate. I give and bequeath to my daughter Mariah her heirs and assigns forever one negro girl named Philis and her increase and two hundred dollars to be raised out of my Estate. My will and desire is that when either of my children shall marry they shall be in immediate possession of the property heretofore given and bequeathed. My will and desire is that the tract of land I now live on shall be sold at any time and in any manner my Executors may think most to the advantage of my Estate and the money arising therefrom shall be appropriated to the purpose of paying my just debts and purchasing another place of residence for my beloved wife Sarah my will and desire is that all the rest and residue of my property remain in my wife's possession during her natural life and at her death all my property except the legacies heretofore mentioned shall be equally divided among my surviving children to them and their heirs forever. Lastly I do constitute and appoint my beloved wife Sarah Executrix together with Arthur Foster my Executor of this my last will and Testament and I do hereby disannull and revoke all other and former will or wills heretofore by me made duly ratifying and confirming this to be my last will and Testament. Allison, Hugh Patrick and David Cooper witnesses to the foregoing instrument after being duly sworn deposeth and saith that they were present and saw Barnett Whittington sign seal and publish the same as his last will and testament and that the said testator at the time of signing was of sound mind & disposing memory and that they also signed at the request and in the presence of the testator and in the presence of each other the two latter heard him acknowledge the same.
