This file was contributed by: Beth Collins collins@negia.net ==================================================================== Coweta County Deed Book S, page 613 State of Georgia } Coweta County } This indenture made this the 2nd day of December 1890 between W M W Smith of the State of Arkansaw & County of [BLANK] Frances M Smith, Susannah C Hughen & Hardy M Smith of Coweta County Georgia, James W Smith of Coosa County Ala. & Rebecca C Welch & Mary A Jones of Shelby County Texas, heirs at law of Hardy Smith late of Coweta Co., Ga. of the first part, and Joseph A Hughen of Coweta County Ga. of the Second part Witnesseth that whereas, after the death of said Hardy Smith a dower in the tract of land hereinafter described was set apart to Susannah Smith Widow of Said Hardy, and whereas the Said Susannah has recently departed this life thereby terminating her life or dower interest, & whereas we the parties of the first part being of majority & wishing to dispose of said land without incurring the expense of administration did consent that Joseph A Hughen & H M Smith acting as our agents should advertise & sell the said land at public outcry & whereas the same was advertised & exposed to sale at the Court House door in the city of Newnan Coweta County Ga. on the first tuesday in December 1890 & whereas the same was knocked off & sold to said Joseph A Hughen for the sum of Eight hundred & ninety nine dollars & Six cents ($899.06) he being the highest & best bidder. Now for & in consideration of the sum of Seven hundred & Eighty Six 68/100 dollars ($786.68) the parties of the first part have the granted bargained sold & conveyed and doth by these presents grant bargain sell & convey unto said Joseph A Hughen the Seven Eighth (7/8) undivided interest in the following tract of land to wit. Eighty Seven & on half (87 1/2) acres more or less, of the north half of lot of land number one hundred & thirty eight (138) situate lying & being in the second district of said Coweta Co. bounded as follows. North by Mary A Fry East by Hill Moore, South by Joseph A Hughen & James Wortham & West by James Wortham & Robt T Carpenter. To have and to hold said tract of land to him the said Joseph A Hughen his heirs & assigns together with all the appurtenances thereto belonging forever in fee simple And the parties of the first will & their legal representatives shall the title to the said 7/8 of said land warrant & forever defend to the said Joseph A Hughen his heirs & assigns against the lawful claims of all other persons.
