Item 1 I wish all my just debts paid after my death with as little delay as possible especially as there is no cause for delay. Item 2 my estate both real & personal which I may own at the time of the deal of myself & of my wife I desire to be equally divided among my children James M Couch Josiah Couch William B Couch Mathew H Couch Mary E Knight Sarah C Edwards Mattie Arnold & Francis Carlton who are my heirs Item 3 I did on the nineteenth day of June Eighteen hundred &Sixty nine I did convey to each one of my daughters Orig: Mary & Sarah & Mattie & Francis a pareil of law valued restrictively at one thousand dollars which I allow them to sell if they desire and to reinvest the proceeds and they are to have no further advancements until my sons above mentioned have been made equal with theirs. Item 4th I have also given to my son Josiah Couch one thousand dollars worth of land and desire that he shall have no more until my other other Sons have been made equal with him & my daughters. Item V I will bequeath to J M Couch William B Couch and M H Couch each one hundred one and fourth acres of land and immediately after he death of myself & my wife of land lots no 168 and north half of 167 valued at one thousand dollars each half to bring them up with Josiah & my daughters already provided for. Item VI I have already given to my three grandchildren sons of Andrew G. Couch died one thousand dollars worth of land the names of the boys are Lemuel W., James Madison and George & they are to have no more of my estate as they together represent their father until all are made equal. Item VII I will & bequeath to my Son M H Couch as trustee & in trust for the use and benefit of my three grand daughters Anna Alice and Mollie daughters of my son Berry Couch deceased at my death & the death of my wife one thousand dollars in money and any further distribution of my estate I direct seventy five dollars to be deducted from their share as I have paid that amount for the Erection of a monument over their father Berry Couch after which they are to have an equal share to be held in trust as the above by M H Couch. Item VIII Upon more mature reflections I will and desire at my death, that the three hundred acres of land reserved to my wife during her life composed of lot no 168 and the north held of No 167 be forthwith divided equally between my three sons J M Couch W B Couch and M H Couch Item IX In lieu of the land as above I will & bequeath to my wife during her life my house and lot in the town of Senoia where I now live and the in twelve hundred dollars of money and such of my household & kitchen furniture as she may desire to keep This house & lot as also they money is be held in trust for her use & benefit during her life by M H couch & at her death is to be equally divided among all my children. Item X It is my will that at my death and the death of my wife all the Estate I may own both real & personal shall be equal divided among my children named above either by sale only agreement as they may elect share & share alike subject to the directions as given above as to my wife and Berry Couch & Children. Item XI I hereby nominate and appoint my two sons J M Couch and Josiah as executors of this my last will and Testament. In witness whereof I hereunto set my and and affix my Seal declaring this to be y last will and testament and declare and publish it as Such in the presence of us whom said testator asked. Sign as witnesses who saw Mathew Couch the testator Sign and Same & who also saw each other Sign the Same for the purpose above declared. Linch C J Fall Codicil State of Georgia Coweta County Whereas I Mathew Couch did on the 10 day of February 1876 sign seal declare and publish my last will & Testament in th presence of John C Brassell M H Couch W D Lynch & C J Fall who signed the said will and Testament as witnesses [and] whereas I am desirous of altering & changing a bequest & desire in said will pertaining my son Mr. James Madison Couch who has deceased since the above will was executed I therefore make and publish this Codicil to said will and testament I revoke and amend that part of my will included in Item 8th So far as relates to my sons Dr. James Madison Couch having advanced to three hundred dollars $300.00 since my last will was made My desire & will is that this amount three hundred dollars $300.00 be deducted from his distribution share in the original will and be divided equally among all my legatees and also Seventy-five dollars $75.00 be deducted from his distribution share and appropriated for the Erection of a Suitable monument on the grave of my Said deceased Son Dr. James Madison Couch. I hereby appoint my Sons Josiah Couch & M H Couch Executors of this Codicil to my last will I also appoint M H Couch as one [of] the Executors of my last will of the 10th day of February 1876 in place of James Madison Couch deceased.
