Elmore, Thomas Morgan and Daniel E. Elmore were present on Thursday the fourth day of December Eighteen hundred and fifty six at the residence of Giles Elmore a married man in said County about fifteen days previous to the death of the said Giles Elmore and about ten o'clock on said fourth day in the forenoon; at said time and place the said Giles Elmore then in perfect perception of his mental faculties called upon us to remember and take notes of what he was about to say; that it had been his intention to make his will in writing and dispose of his property some time before but that it had not been convenient for him to do so and he had neglected it. He now wished us to understand that it was his will and desire that after his death his land situate in the County of Sumpter [sic] and said State should be sold to pay his debts and if said land should prove insufficient to pay all his debts then he desires his bay mare sold to pay the balance of his debts. The said Giles Elmore then and there further said that he had already given to his daughter Sarah F. Elmore her portion of his Estate, that said portion remained there but that he had given it to her - that the one hundred acres of Land which he had bought his three sons then living with him had worked and paid for and that he desires his said three sons to have said One hundred acres of Land; and that he willed and desired the rest and residence of his property after the payment of his debts to remain and belong to his beloved wife Amy during her natural life for the purpose of rearing and educating his children then living with her and for the purpose of supporting herself and at the death of his said wife he desired and willed that said last named residue of his property should be equally divided among the children of the said Amy; And the said Giles Elmore then and there in presence of us stated that he desired and willed that his said wife should be Executor of this will and see that al his wishes were carried out and that it was his desire that his friend David Linch should assist his said wife in carrying out this his will; And we further state that the said Giles Elmore died on the 19th December 1856. Elmore pg. 129 Giles Elmore's Will Georgia } Coweta County } Court of the Ordinary January Term 1857 In person appeared in open Court Thomas Morgan, Sarah F. Elmore and Daniel E. Morgan who being duly sworn upon and say that the above paper signed by them contains the last request and verbal will and testament and disposition of the real and personal Estate of Giles Elmore, late of said County, deceased, that she said Giles Elmore was at the time he declared and published his said will of sound and disposing mind and memory; that he made and delivered said verbal will in our presence and Called upon us to bear witness to the same at the time he declared it that he made said will on the 4th day of December 1856 at and in the house of his habitation in said County and during his last illness or sickness; that he made and pronounced said will voluntarily and of his own accord and without any compulsion whatever; that the facts set forth in said paper and writing are true and that more than fourteen days have elapsed since the death of the said Giles Elmore and that said testamentary words were put in writing six days after the death of the said Giles Elmore and within 19 days after the making of said verbal will.
