May 24, 1849/January 1850 Georgia Coweta County I Bird Parks Senr Considering the uncertainty of this Mortal life, and wishing to make such disposition of the property that I have accumulated as will in my opinion best promote the interest of my beloved Wife & Children, do make and publish this my Last Will and testament in manner & form following (Viz) First I desire to be decently buried in my family burying ground and without pomp. Item 1st I give and bequeath unto my beloved wife Martha Parks & my Son Bird Parks Jr the lot of land whereon I now live No. 70 and the Thomas lot of land adjoining the __on the west No. 59 for their only proper use & benefit for & during the natural life of my said Wife and at the death of my said Wife, I give & bequeath unto my son Bird Parks Jr the aforesaid lot of land No 70 to him & his heirs forever and my will is that lot of Land No 59 reverts back to my Estate after the death of my wife and be equally divided between Thomas H. Parks, Polly Abraham, Emily Berry, Ann Perkins and Martha Cook ~ Also I give and devise unto my said wife the following Negroes Charlotte and her son Henry, Jane a Woman, Alfred a boy & Hulda & her two children ~ Also I give unto my said wife two choice bedsteads, feather beds & furniture such as she may choose, as many pork hogs or hogs to fatten and sows & pigs as she wants two horses such as she may choose and as much corn potatoes & other pro__ as she may want for the use of her family, and Stock for twelve months ~ Also I give unto my son Bird Parks Jr one good bedstead feather bed & furniture two cows & calves & two good sows & pigs. Item 2nd I give and bequeath unto my son James Parks one lot of land whereon he now lives No 40 to him and his heirs forever. Item 3rd My will & desire is that my three lots of land No 91, 55 & 68 be divided among my Son Thomas H. Parks and my four daughters, Polly Abraham, Emily Berry, Ann Perkins & Martha Cook as equally as may be. Item 4th In order to make my daughter Polly Abraham as nearly equal as can well be done with my other Children for property ___ ____ I give and devise unto her Fanny a Negro Woman, Tucky, a Negro Woman & her child Kitty Ann. Item 5th My will is that the part of my Estate which may fall to my daughter Polly Abraham as her portion shall remain in the hands of my Executor or Executors she receiving the net proceeds thereof annually for a support during her life unless my executor or Executors should believe it prudent & safe to give it up to her after being advised by some person skilled in the law and after her death to be equally divided between her Children. Item 6th After the death of my said Wife my will is that all the Negroes & perishable property which I have given to her during her life shall revert back to my Estate & be divided equally among all my Children. Item 7th My will & desire is that the balance of my Estate of whatsoever kind or description it may be shall be equally divided between my several Children, to wit Polly Abraham Emily Berry Ann Perkins Martha Cook Thomas H. Parks James Parks & Bird Parks Jr and I do hereby constitute and appoint my beloved Sons and trusty friends Bird Parks Jr, Thomas H. Parks and Andrew J. Berry Executors of this my last Will and testament. In witness whereof I have hereunto set my hand & seal this 24th day of May 1849.
