This file was contributed by: Jeanie Smith Zadach DaisyZ@aol.com ==================================================================== FHC #047039 Coweta Probate Court Book A, Page 20 Georgia Coweta County I Charles Smith being afflicted in body but enjoying my usual reason and understanding but, knowing the uncertainty of the mortal life and having a desire to make such disposition of the property that I have accumulated as well best promote the Interest of my beloved wife and those herein after named, do make ordain and publish this my last Will and Testament in manner and form following via: Item first I give and bequeath unto my beloved wife Elizabeth Smith all my Estate both real and personal (except what is her after named) during her natural life and at her Death the one half to be equally divided between my brothers and Sisters or their Children giving to each ones Children the Share of a brother or Sister. The other half to be divided in the same manner between her brothers of the whole or paternal line. Item 2nd I leave to be sold one Negro Boy by the name of Dempsy to be Sold for cash and to be equally divided between the Wife of Harrison Smith & Miles Smiths Wife my Brothers but to be under the Controle of those persons herein after named to wit the former under the Controle of my Executor to be given her as She may in his opinion need the Same. The Latter ones part to be placed in the hands of Isham Smith, Joshua P. Shropshier and George G. Glass by my executor and by them used as they may think best for the interest of her the wife of said Miles Smith. Item 3rd I give unto Joshua P. Shropshier one Sorrel Colt with blaze face which my mare brought this Spring. Item 4th The Sale of the Negro boy Dempsey which I have left to be Sold for the use of the wife's of my two brothers before named will be deducted from their Shares in a final division of my property so as to make the rest of my Brothers and Sisters & their Children equal to them or theirs. Item 5th And Lastly I constitute and appoint my Wife Elizabeth Smith and her brother Thomas Hardeman as my Executrix and Executor to this my last Will and Testament in witness where of I hereunto Subscribed my name and affixed my Seal this first day of October in the year of our Lord one thousand eight hundred and thirty four Charles Smith {LS} Sealed and acknowledged in the presence of John Featherton Moses Wilks John Dickson Attested to by above on January 5, 1835
