This file was contributed by: Jeanie Smith Zadach DaisyZ@aol.com FHC #0470379 Probate Court Book A, Page 93 March 3, 1844/September 1844 Georgia Coweta County I Mark Smith being sick but enjoying my usual reason & understanding and calling to mind that all must die and having a desire to dispose of my worldly goods in such way and manner as shall best promote the interest of my beloved wife and Children do make and order this my last Will and Testament in manner and form following. (To Wit) Item 1st My will and desire is that all my just debts be paid. Item 2nd My will and desire is that all my property be equally divided between my Wife and Children as they become of age or Marry, provided my Sons do not marry under the age of Twenty One Years, in case they should my Executors will not give them their property until they are of Lawful age. Item 3rd My will and desire is that my property be kept together if it can be so done by my Executors, if not they must do with it in that way they think best to promote the Interest of my Children. Item 4th My will and desire is that the property I give my wife is only a life Estate and at her Death will revert back & become a part of my Estate and be Equally divided among my children, and that said property is not to be removed from the County of Coweta. Item 5th May will and desire is that my Executors keep control and manage the property of my son John H. Smith as I consider him incapable of managing the same. Item 6th I constitute and appoint Isham Smith, Joshua F. Shropshire & George Glass Executors of this my last Will and Testament in Witness whereof I have hereunto subscribed my name and affixed my Seal this Twenty third day of March in the year of our Lord one thousand Eight hundred and forty four ~ Signed sealed and acknowledged in the presence of Bird Parks Sen. Brown who being duly sworn deposeth and say that they heard Mark Smith the within named Testator acknowledge, seal & publish and declare this writing contained in this __to be his last will and testament and he at the time thereof he was of sound mind and disposing memory and that he did _____and without compulsion and that they subscribed to the same as witnessed in presence of the Testator and each of the subscribing witnesses.
