Sale: John Miller to Benjamin F. Killian State of Georgia Dade County This indenture made this twenty seventh day of December in the year of our Lord one thousand eight hundred and fifty two between John Miller of the State and County aforesaid of the one part and Benjamin F. Killian of the State and County afore said of the other part witneseth that the said John Miller for and in consideration of the sum of three hundred and fifty dollars in hand paid at and before the sealing and delivery of these presents the receipt whereof is hereby acknowledged has granted bargained sold and conveyed and confirmed and by these presents does grant bargain sell and convey and confirm unto the said Benjamin F. Killian his heirs and assignees all that Lot or parcel of land situated lying and being in the County of Dade and known and distinguished as the South West half of Lot number two hundred and fifty four (254) in the Eleventh District and Fourth Section of said County containing eighty acres more or less. Commencing at a rock corner South of the North East corner on the original line thence Easterly line to the Crop fence thence to a post oak tree the base line to a walnut tree to a post oak thence to a rock corner on the original line North of the South East corner of the original survey thence the original survey around to the beginning rock corner to have and to hold the land tract or parcel of land with all and singular rights members and appurtenances thereunto appertaining to the only proper executors and administrators and assigns in fee simple the said John Miller the said bargained tract or parcel of land unto the said Benjamin F. Killian his heirs executors and administrators and assigns against all and ever person or person sale and will warrant and forever defend by virtue of these presents in witness whereof the said John Miller has hereunto set his hand and affixed his seal and delivered these present the day and year first above written. Registered March 15, 1858 Serug Killian, Clerk Additional Comments: The Millers moved to Rising Fawn, GA from Monroe County, TN ca. 1835; John was b. 1803 in TN (son of James SC); he married (1827, Monore Co. TN) Nancy Mary Wilson b. 1806 TN (daughter of Joseph Wilson). John Miller was a probate and circuit judge in Dade County. Sons of the Millers who owned land in Dade County were George R. Miller, Joseph W. Miller, James M. Miller and John Thornton Miller. Their daughter, Elizabeth, was married to a Tatum.
