Tenn. on or about October A.D. 1814, for the term of 6 months and continued in actual service in said war for the term of six months, and whose services terminated by reason of honorable discharge April 1815. She further states that the following is a full description of her said husband at the time of his enlistment, viz: 29 yrs old, farmer, Pendleton or Spartanburg District S. Carolina -- 5 ft 8 inches, dark or dark sandy hair, blue eyes, fair complexion. She further states that she was married to the said Samuel McBee at the town of Jasper in the county of Marion in the state of Tennessee on July 1839, by one Rev. Michael Burkhalter, who was a minister of Gospel, and that her name before her said marriage was Milley Francis; and she further states that her husband's first wife was Ellender Standridge who died March 1839. Applicants first husband was Josiah Francis who died July 1836, and that her said husband Samuel McBee died at Trenton in the State of Georgia on the Eleventh day of August, A.D. 1862. [Jesse McBee, age 52 years, whose residence was Alto, Texas, and Jacob P. McBee, age 59 years, whose residence was also Alto, Texas swore that they had known Millie McBee for 30 years, and that she was the wife of Samuel McBee, deceased who had served as a private in the company of Captain Barba Collins in the Regiment of William Metcalf, in the War of 1812. The statement was signed by Jesse McBee and Jacob P. McBee.] On this 12th day of March 1880, personally appeared before me, Mrs. Millea McBee, a resident of the state of Texas and county of Cass, who being first duly sworn according to law doth on her oath make the following declaration, that Samuel McBee was born July 7th 1785 and died August 11 1862, aged 77 years one month and four days and that Tennesee McBee was June the 24th 1840, and that Silas was born February 15th 1842, and that Asa J. McBee was January 16th 1844 and died May 31st 1868 and that William H. McBee was born June 24th 1846 and died October 18th 1872 and the two surviving, Tennessee and Silas B. McBee, live in Georgia and that the original record of the ages of the family I am unable to obtain. [signed] Millea McBee [Witnesses: W.H. Blanchard, A.B. Blanchard] ******Deposition of Malilah Cooper [daughter of Millea by Josiah Francis, married Harmon Cooper]: "I am 48 years old next September 1880. I will say I know [sic] Samuel McBee. He was my stepfather and Milly Francis was my mother. My mother married Samuel McBee in July 1839. They were married by Reverend Michael Burkhalter in Sequach[ie] Valley near Swift School. I saw them married. The Clerk says to me that the license records were destroyed by Federal soldiers in the late war. I heard my stepfather say he was in the War of 1812 and was in the Battle of New Orleans. His character was a truthful man. He died the 11th of August 1862 near Trenton, Georgia. His wife never married no more. I am told she is in Cass County, Texas at my brothers." Minter, Clerk of the County Court of said County, do hereby certify that the marriage records of my office was destroyed during the late war and that a transcript of the marriage of Samuel McBee to Milly Francis cannot be had. Minter, County Clerk. ******Declaration of Margaret Maxwell: State of Texas, Cass County Personally came before me, a notary public in and for said county, Margaret Maxwell, who being duly sworn deposeth to say that she was an eye witness of the death and burial of Michael Burkhalter an Baptist Clergyman who died in Cass County, Texas in the year 1864 and that I, Margaret Maxwell, are about forty yeras of age and that I have no interest directly or indirectly in making this affidavit as in the proving of this pension or bounty who Milly McBee is now a petition and alive, blind and poor. Miles, a notary public for the State of Texas and County of Cass certify that I have been personally acquainted with Margaret Maxwell for twenty five (25) years and know her to be a lady of truth and veracity and highly respectable and I certify that I have no interest directly or indirectly in this pension and that I have explained to the subscribing witnesses the object of the petition. This 23 of December 1879. [signed] A. Miles. ******Affidavit of Arena Maxwell: 23 December, State of Texas, Cass County Deposition of Arena Maxwell who came before A. Miles, a notary public in and for the County of Cass, who being duly sworn by me deposes and says she was personally acquainted with Milly Francis before she married Samuel McBee whom the said Milly Francis married in the year 1839 - eighteen hundred and thirty nine - in Marion County, State of Tennessee, and that I Arena Maxwell was an eye witness at the time and place of the marriage and heard the ceremony then and there administered by Michael Burkhalter, Baptist Minister of the aforesaid county and state of Tennessee and that I, Arena Maxwell was an eyewitness of the death and burial of said clergyman in the year 1864 and that the said Milly Francis is the living widdow of Samuel McBee and that the Milly McBee is the person named petitioning here for pension who is now blind and poor and living in Cass County, Texas, and that I, Arena Maxwell, have no interest directly or indirectly with the claim as in making this affidavit and that I am now about fifty-nine (59) years of age. Miles. ******Affidavit of Teresa Smith: 21 July 1879, State of Georgia, Dade County In person appeared before the undersigned clerk of the Superior Court of said county Teresa Smith, who being duly sworn on oath says that she was present and witnessed the marriage of Samuel McBee and Millie Francis. They were married in 1839 in Marion County, Tennessee, and that they lived together as man and wife from that time after time up to the death of Samuel McBee which occurred in 1862 and that she saw what purported to be a discharge from the United States service as a soldier in the War of 1812 in the possession of Samuel McBee which he frequently said was his discharge. That she is not interested either directly or indirectly in the prosecution of the claim of Millie McBee for pension. [signed] Teresa (her x mark) Smith. Cole, Clerk of Superior Court, Dade County, Georgia. ******Affidavit of Elizabeth McBee: August 1879, State of Texas, Cherokee County I Elizabeth McBee do solemnly swear that I was present when Samuel McBee and Millie Francis were married, that they lived together as husband and wife until the death of Samuel McBee which occurred in 1862 and that I have no pecuniary interest in prosecuting this claim either directly or indirectly. Pace: 29 December 1879, State of Georgia, Dade County Personally appeared Benjamin F. Pace before the undersigned, a Justice of the Peace in and for said County who being duly sworn deposeth and saith that he was personally acquainted with Samuel McBee and his wife MIlly McBee for fifteen or twenty years and that they lived together as husband and wife to the date of Samuel McBee's death which was as well as I recall about the year eighteen hundred and sixty two. I will be fifty five years old the 6 of next March. I am not related to the above named party and have no interest in the matter and that the said Milley McBee has not married to my knowledge since the death of her husband, Samuel McBee. O'Neal: 6 October 1880, State of Georgia, Dade County Personally came before me, the undersigned, Z. O'Neal, who being duly sworn says that he attended Samuel McBee in his last illness and says that the said Samuel McBee died in the year 1862 in said County of Dade and State of Georgia, that deponent closed said Samuel McBee's eyes after death and knows that his death took place in the year 1862 and about August of said year, and deponent is not related to the said Samuel McBee, his widow nor any of his family and has no interest in the pension that might or may be drawn. [signed] John McMahan, Justice of the Peace. *****Affidavit of Andrew Brown: 6 October 1880, State of Georgia, Dade County Personally came Andrew Brown before the undersigned and after being duly sworn says that he was acquainted with Samuel McBee in his lifetime, says that said McBee died about August 1862 in said County of Dade and State of Georgia. Deponent for this service that he is in no way related to said Samuel McBee his widow nor any of his family and further swore that he has no interest in any pension that may or may not be drawn. [signed] Andrew Brown Sworn to and subscribed before me this 6th Oct. 1880. [signed] John M. McMahan, J.P. ******Information given by James M. Francis [son of Millea], supporting her pension application, and in response to questions posed by the pension board: "Yes, I knew them both during the years 1838/39/40. Mrs. Milly McBee is now in Cherokee County, Texas. Samuel McBee is dead - died in Dade County, Georgia during the war, about 1862. They moved from Tennessee to Georgia about 1841 and lived there until the death of Samuel McBee. She moved and lived a while in Alabama and from there to Texas in 1876. She lived with me during the year 1877. Have had letter correspondence with her in Cherokee County. They were husband and wife - were married in 1838 or 1839. I was an eyewitness to the marriage. They were married by Michael Burkhalter, a Baptist Minister. He is now dead - died here in this county about 1860 or 64. Saw him die and helped to bury him. I heard Samuel McBee say that he was in the War of 1812. It was common report in the County where he lived and was not contradicted. He was considered a reliable man. My recollection is that he received a land warrant but don't know the amount of it. I think I have seen his discharge as a soldier. Do not know what became of it. Mrs. McBee told me it was destroyed or carried away during the war by U.S. Troops. It was recorded in the Bible. Don't know what became of the family bible. I was quite young at the time, about 9 or 10 years old, but remember seeing it recorded in the bible. They had four children born to them named Tennessee, Silas Benton, Asa Jones, and William Hale. I cannot state positively as to the time of their births. I think Tennessee was born in 1840 or 41. I think there was about two years difference in their ages. I don't know anything of the church record. I don't know what company or regiment he served in. From common report among the neighbors and from what I learned of him he was in some Tennessee Company and was in the Battle of New Orleans under Jackson. It was the current report through the county. I have heard him talk with other parties about the battle, who were in the fight with him, and perhaps the same company. It was the common talk - never heard of anyone disputing the report. I know that he received a land warrant for his service. I saw her last August was a year ago. She was at Kildare on T&P RR on her way to Cherokee County, Texas, her present residence is in Cherokee County and Post Office Alto in that County. She is 68 or 70 years old. She is blind entirely dependent and feeble, has no means to live upon. She has never married again. Samuel McBee died about the year 1862 in Dade County Georgia." [J.M. Francis swore to this statement on 2 May 1879, Cass County, Texas, before J.S. H.F.W., Nov. 29, 1919. *This document is found in Millie's pension file and gives her date of death: "Mr. D.A. Carpenter, Knoxville, Tennessee August 4, 1896 Sir, Mrs. Millie McBee died on the 29 day of May 1896 which makes her only entitled to about one third the amt. in voucher. The following description of Samuel McBee is found in Millea's pension file: 29 years old at enlistment, a farmer, born in Pendleton or Spartanburg District, S. Carolina, 5 ft. 8 inches, dark or dark sandy hair, blue eyes, fair complexion. Additional Comments: Samuel MCBEE was b. 1785 in SC. He married first Ellender STANDRIDGE of SC; they moved to Franklin, later Marion Co., TN. Ellender died in 1839 and Samuel remarried that same year to Mrs. Millie FRANCIS (nee MAXWELL; daughter of Thomas and Mary MAXWELL). Millie's first husband was Josiah FRANCIS. By him she had the following children: Teresa, Jeremiah, James M., Malliah, Elizabeth, Emily, Josiah. By Samuel, she had: Tennessee (female), Silas Benton, Asa Jones, William Hale. The family moved to Dade Co., GA about 1841. Samuel MCBEE was a minister in the Primitive Baptist Church and traveled extensively in the Dade Co. area, ministering to various churches. He was also a state senator in 1849/50, as well as a justice of the inferior court in Dade Co. from 1845 to 1853. He died in Dade Co. in 1862. His widow lived for a while in AL and TN before moving to Cherokee Co., TX to be with her children. She died there in 1896.
