I, William Burt of said State and County being of advanced age and knowing that I must shortly depart this life deem it right and proper both as respects my family and my self that I should make a disposition of the property with which a kind providence has blessed me do therefore make this my last Will and Testament hereby revoking all others heretofore made by me. 1st Item, I devise and direct that my body be buried in a decent and Christian like manner suitable to my circumstance, in life. My soul I trust shall return to rest with God who gave it as I hope for eternal Salvation through this merits and atonement of the Blessed Lord and Saviour Jesus Christ, whose religion I have professed, and I hereby trust enjoyed for some fifty-six years. 2nd Item, I devise and direct that all my just debts be paid without delay by my executors herein after appointed as I am unwilling my creditors should be delayed in their rights especially as there is no necessity for delay. 3rd Item. I gives and bequeath and devise to my beloved wife Mary with whom I have lived in the strictest quietude for fifty-six years my entire property, both real and personal, for her uses enduring her life or widowhood if she out lives me, and after her death and mine or her marriage it second time the property to be disposed of in the following manner herein after mentioned. 4th Item, I give, bequeath and devise to my daughter Mary Elizabeth, a certain tract of land, the North part of lot no. Nine Hundred and Two {902} and Nine Hundred and Three {903} in the Fifth District and First Section of Original Cherokee, then Lumpkin, but now Dawson County- the conditional line runs as follows Commencing at the North West Corner of lot no Nine Hundred and Two {902} thence south along the original line until it crosses the creek to a conditional corner on the South east bank of the Creek thence near an east course to a white oak sapping near the roads at the foot of the hills with three chops each side of it, and a crop mark on it each side- thence east to a large wild Cherry tree in the fields with three hacks each side, thence east to the persimon sapping by the roads at the lane, three hacks each side, thence across the road thence north along the road to the house-lot thence an east course to the knuckelsville road, thence the road near an east course to the east line of lot No. Nine Hundred and Three,{903} thence North to the North-east corner of said lot, thence west along said line to the North-west corner of lot No Nine Hundred and two, {902} the starting point containing fifty acres more or less. 5th Item I give bequeath and devises to my son Clark G. Burt, a certain tract on parcel of land in the Fifth Districts and First Section of Originally Cherokee, then Lumpkin, but now Dawson County, the southern portion of lots of land Nos Nine Hundred and two {902} and Nine Hundred and three {903} and the north part of lot Nos Nine hundred and Thiry-four{934} and Nine Hundred and Thirty -five {935}- the conditional line runs as follows Commencing at a conditional corner near the center of the west line No Nine Hundred and Two on the south-east bank of the creek, thence south along the original line, crosses the creek the second time thence on east course to a large white oak tree at the big spring, thence up the hill east to a Red Oak sapping on a rocky point, thence south-east course to a white tree with three chops on the other sides of the branch, thence a north east corner to a poplar stump on the bank of the branch at the mouth of the ditch, thence to a red oak tree, three hacks each sides, thence near the same direction to a red oak three hacks on each side, thence same direction to a red oak on top of the hills, three marks and X each side, thence near an east course to the original line near a large chestnuts tree on the line of lot Nine Hundred and Thirty-four {934}, thence north to the nuckelsville Road on the east the east line of Nine Hundred and Three {903} thence west along the conditional to the creek at the starting point containing fifty=six acres more or less. 6th Item I give bequeath and devise to my son David J. a certain tract or parcel of land, the southern portion of lots Nos Nine Hundred and Thirty-four {934} and Nine Hundred and Thirty-five {935} in the Fifth Districts of First Section of originally Cherokee then Lumpkin but now Dawson County. Conditional line runs as follows commencing at the south-west corner of lot No. Nine Hundred and Thirty-five {935} thence east the original lines to the south-east corner of lot no. Nine Hundred and Thirty-four {934} thence north to a conditional corner near the large chestnut tree thence west along the conditional line on the South side of divin before. Item the 5th to this starting point on the creek-containing fifty-three acres more or less. 7th Item, I give bequeath and devise to my daughter Nancy, the undivided half of lot of land No Eight Hundred and Sixty-five {865} and Nine Hundred and Four {904} in the Fifth District and First Section of Dawson County Eighty acres more or less to the use of herself and her bodily heirs--not subject to the control of her present or any future husband. 8th Item, I give bequeath and devise to my daughter Arminda the undivided half of lots Nos. Eight hundred and Sixty-five {865} and Nine Hundred and Four {904} in the Fifth District of the First Section of Dawson County containing Eighty acres more or less to the use of her and her bodily heirs not subject to the control of her present and any future husband. 9th Item I give devise and bequeath to my children this foregoing, several parts of land thereto above mentioned and Clark G., David J., and Mary E. is to pay twelve dollars a piece to be divided between Nancy and Arminda to make _____ parts equal with the rest, with all the rights members and appurtenances and privileges to said lots of land in any wise appertaining or belonging forever. 10th Item I give bequeath and devise to my children Clark G. David J Mary E. Nancy and Arminda to be equally divided among them the entire residue of my property personal consisting of what ever it may be. 11th Item I hereby constitute and appoint my beloved sons Clark G Burt and David J Burt my executors to this my last Will and Testament.
