Item 1st I direct that my just debts if I leave any at my death, be first paid out of the proceeds of my estate. Item 2nd After the payment of my debts as aforesaid I devise and bequeath to my wife, Luella F. McGehee, should she survives me, all of the property that I may leave at my death, both real, personal and mixed, to have and to hold said property to my said wife for and during the term of her natural life, and after her death to be disposed of as directed in the next item of this will. Item 3rd After the death of my said wife, I direct that all of my said property be equally divided among all the then living children of the five following persons to wit T.W. Bates, late of Muscogee County, State of Georgia, now deceased; Mrs. Alice Denton late of Fulton County, State of Georgia, now deceased, C. D. Martin, of Dekalb County, Georgia; George C. Bates of the State of Texas and Mrs. Eugie Tate,born Eugie Bates of Muscogee County, Georgia. By the children of Alice Denton is meant the children of her body, and not the children of her husband by any other wife. It is my will that my said property be divided among the living children of the aforesaid 5 persons upon a per capita and not upon a per stripes bases and that the distribution is to be made among those of the said children who are in life at the time of the death of my said wife. The term "Children" is not hence to be constrained as embracing the descendants of children. In the event that I should outlive my said wife, I direct that, at my death, all of my said property be distributed in the same manner and upon the same basis as already forein provided for said distribution after the death of my said wife, in the event of her surviving me; that is to say, in the I survive my wife, said property at my death is to be divided equally among the then surviving immediate children of the 5 persons herein above named. Item 4th I nominate, constitute and appoint, C.D. Martin as execution of this will, and direct that he be relieved from the necessity of filing any inventory or appraisement of making any returns in any court.
