Tate, respectfully showiest that she is the widow of said Charles M. Tate deceased, late of said County, and that her four miner children are dependant on her for a support, and that said Estate is unrepresented, she therefore prays an order appointing five discrete commissioners to set aside twelve months support for the benefit of her and her said miner children and petitioner will ever pray, B.H. Gee for Magdalina Tate, __________________________________________________ At chamber- Feby 12th 1879, Upon hearing the above petition, it is ordered by the Court that D. W. Kelly, Joseph W. Cooper, John (?), William (?) and Nathaniel M. NeSmiith is and they are hereby appointed commissioners to set apart twelve months support as prayed for in the terms of the law, Master O' Neal Ordinary, _______________________________________________________________ State of Georgia } Decatur County } The undersigned in the discharge of their duty finding that the Estate of Charles M. Tate of said County deceased does not exceed in value the sum of Five hundred dollars, have set apart the whole of said Estate for the years support for is widow and four miner children, said estate so set so set apart will be seen in the following schedule to wit: 50 acres of land lying in the SW. Corner of lot no. 369, in the 16th District of said county and valued at 200.00 One Sorrel Horse name Holly valued 90.00 One Black Mule Beck 70.00 12 head cattle @$60.00, 7 Head Hog's @ 10.00, "Buggy" $43.40 110.00 One wagon @ 30.00 Total amount $500.00 And in addition to the above we have set apart for the use of said widow and miner children the following amount of household furniture wiz: One bed and bedstead valued @ $15.00 One safe 5.00 Total amount $20.00 Witness our hands auth Seals. Tate It is ordered that the same be recorded Master O' Neal Ordinary __________________________________________________________ Additional Comments: Charles M. Tait is the son of William A. Tait of Decatur County Ga. He served in the Civil War and after married Magdalina (?) in Decatur County. The 4 miner children are as follows: Mattie Lou b 1871, Emma K. b 1874, John Henry b 1875 and Charles H. b 1877. Magdalina remarried to G. W. Smith 1881 in Mitchell County GA. She was listed on the 1880 Census as a widow with her children, then found on the 1910 Census record as Maggie Smith with Frank Smith (son) and Charles Tate (Son). I have no further information on her as it seems she passed away some time between 1910-1920, as well as her son Charles H. Tate. I of course am looking for her parents and her maiden name. In Decatur County Probate records there are about 3 books full of Widows Year support. This was some thing "new" to me and could be of some help to others as well. This is proof that Charles M. Tait did died in Decatur County and gives a time frame as to his death as well. Please contact me if you have any information on the above Magdalina Tate Smith.
