This file was contributed by: Rick richter@entercomp.com ==================================================================== The following is the will of Malcom Buie who, along with his brother John, migrated from Cumberland Co., North Carolina to Tattnall County, Georgia around 1800. Archibald followed three or four years later. They later moved further south to Decatur County, Georgia where Malcom died in 1829. His children and his widow, Margaret Buie, then moved on to Gadsden Co., Florida where she died about 1845. John and Archibald Buie then migrated on to Henry County, Alabama in the 1850's. In the name of God, amen, I, Malcolm Buie of the county and state aforesaid, being in perfect sense, recollecting that it is appointed for all men once to die, do make this my last will and testament in form and manner following: First I recommend my soul to God who gave it, and my body I recommend to the earth from whence it came to be buried at the discretion of my executors in a Christian manner. Secondly I give and bequeath unto my loving spouse Margaret Buie a negro man named Charles or his worth and a negro woman named Phille and ten cows and calves and a bed and furniture and all my household and kitchen furniture during her widowhood. Thirdly, I give and bequeath unto my beloved daughter Margaret Buie McDonald a certain negro girl Nelly between 5 and 6 years of age, all her own claim in my stock of cattle with all I let her have when she married to be full occupied and enjoyed by her and the heirs of her body. If any there be .... all the aforementioned, and if no heirs the said property at her death to be returned to her brothers. Fourthly I give and bequeath unto my eldest son John Buie one negro fellow named Jack (now grown).** likewise his riding horse, saddle and bridle with all his own claim of my stock of cattle and my rifle gun. Fifthly, I give and bequeath unto my daughter Mary Buie Gil(?)burn(Gilbourne) a certain negro girl name of Martha about two years of age, likewise five cows with their calves with a bed and furniture which she has now in her own name and posession. Sixthly, I give and bequeath unto my son Archibald Buie a negro boy named Harry about twelve years old, likewise his claim of my stock of cattle with a horse and bridle and saddle to be furnished for him Equal in value to that of his brother. Seventhly, I give and bequeath unto my youngest son Malcom Buie a certain negro boy named Cain about eight years old likewise his own claim of my stock of cattle likewise his own horse and a good bridle and saddle. Eighthly, I give and bequeath unto my youngest daughter Ann Nepsay Buie a certain negro boy named Tim about four years old and all her own claim in my stock of cattle with a good bed and furniture. Ninthly and lastly, it is my earnest request that my lawful executors after my decease first shall pay all my funeral expenses and next my lawful debts of every kind and all the rest of lands and tenements that I may be the lawful proprietor of at my expiration or decease, I give and bequeath unto my three sons Vis: John, Archibald and Malcom to be freely and fully their right and lawful property free from claim whatsoever, and the remaining of my stock of every kind to be equally divided between my three sons John, Archibald and Malcom after Archibald, Malcom and Ann Nepsy Buie will get twelve months schooling: The two negros as above named and the two work cretures a sorrel horse and mare I bequeath unto my spouse during her widowhood, and when that will cease then to be divided equally between my three sons John, Archibald and Malcom Buie being it and behoof free and clear from any enthralmint whatsoever and as to the cattle I left my wife during widowhood I want them and their increase to be divided to the bodily heirs of my daughters should they have any at their time of death otherwise all the property pointed out to them in this my last will and testament to be returned to their brothers. Further and lastly I appoint and constitute Daniel Buie and my own son John Buie my two and lawful executors after my death. Signed, sealed and delivered in the presence of us, and we in the presence of each other. Fifth day of January A. D. 1827.
