Will of William Yates 17 May 1875 Decatur County, GA State of Georgia} Decatur County } In the name of God, Amen: I, William M. C. Yates, of the County of Decatur and State of Georgia, being of sound and disposing mind and memory, and being desirous to settle my worldly affairs while I have strength so to do, do make and publish this my last will and testament, hereby revoking all wills by me at any time heretofore made. ITEM 1 - I give and bequeath to my beloved wife, Christina E. all my property of whatever kind I may possess at the time of my death (except such as may be hereinafter given specially in this my will, to my children) for and during her natural life and at her death, I desire that the property may be divided so as to give my sons each three dollars, to where my daughters get two dollars. ITEM 2 - I give and bequeath to my daughter, SMITHA JANE FUNDERBURK one half of Lot of Land Two Hundred and Twenty Three (223) in the 27th District of Decatur County (which she now has in possession) and two cows and calves. ITEM 3 - I give and bequeath to my son WILLIAM JEFFERSON the West half of Lot of Land No. Two Hundred and Sixty Six (266) in the 27th District of said County of Decatur, one gray mare named Ella and two cows and calves. ITEM 4 - I give to my son HENRY MILTON the East half of Lot of Land No. Two Hundred and Sixty Six (266) in the 27th District of said Decatur County, and one horse of about same value as the one given to my son William Jefferson, also two cows and calves. ITEM 5 - I give and bequeath to my daughter REBECCA ANN TRAWICK one hundred and twenty five acres of land to be taken off of either Lots 24 or 44 in 27th District as she may select and two cows and calves. ITEM 6 - I desire and direct my executrix hereinafter named and appointed to give to my son JAMES THOMAS at his maturity or marriage one half of Lot of Land No. 295 in the 27th District, one horse and two cows and calves. The horse to be of same value as those given to the other boys. ITEM 7 - I desire and direct that my Executrix turn over to my son, JOHN B. upon his arriving at maturity or marriage, one half of Lot of Land No. Two Hundred and Ninety Five (295) in 27th District, one horse and two cows and calves. ITEM 8 - I give and bequeath to my youngest daughter ELLA FLORANCE (to be turned over to her upon her marriage or arriving at the age of 21 years), one half of Lots 24 or 44 in the 27th District and two cows and calves. ITEM 9 - It is my wish and I so direct that if my wife should at any time desire to do so, she may give to each of my children, two cows and calves. ITEM 10 - I desire that my wife should keep possession of all the property hereinbefore given to my minor children until they marry or arrive at age. ITEM 11 - I desire and direct that at the death of my wife, that hy heirs meet and amicably divide the property remaining without the intervention of any court or administration and in the event of a failure on their part to divide, I desire and direct them to call in five discrete and proper persons, who shall divide said property, as directed in Item 1st of this my will, that is the sons to receive each three dollars, to the daughters each two dollars, and in that proportion till all is divided. ITEM 12 - I do hereby nominate and appoint as my executrix my wife, and my son HENRY MILTON YATES, and in the event, my wife should die before all my children are of age, or marry, then I desire that my said son, Henry Milton, shall take charge of such as are minors, and their property, until they shall arrive at age or marry. ITEM 13 - It is my desire, and I so direct, that after my death, my Executors take charge of my property, and divide it as directed in this will, without the aid or intervention of the Court of Ordinary, except for the purposes of probating this will; that they be not required to make any returns to said court but that they take receipts for all property turned over under this will to any of the children.
