J. Spear, of the State and county aforesaid duly constituted Administrator of Estate of Jesse Spear late of said county, Deceased of the one part and James Brown of the County of DeKalb the other part. Witnesseth, that whereas by virtue of an order granted by the Honorable the Court of Ordinary the said County of Jasper, when setting for Ordinary purposes previous notice of said application having been given agreeably to the Statute in such cases made and provided on the first Monday in the month of November, in the year Eighteen Hundred and sixty-seven to the said Administrators to sell the Real Estate of the said Jesse Spear Deceased, amongst which Real Estate was the north half of lot of land number one hundred and seventy-seven in the Fifteenth District of (originally Henry now) DeKalb, except five acres in the north west corner of said half lot containing eighty-three acres, be the same more or less, and after the said half lot or parcel of land was duly and publicly advertised in conformity to law, the same was put up and exposed to sale to the highest bidder at the door of the Court House in the Town of Decatur, DeKalb County, within the legal hours of sale on the first Tuesday in January in the year eighteen hundred and sixty-eight by said John A. J. Spear, Administrator as aforesaid when the said half lot or parcel of land was knocked off to the said James Brown at the price or sum of sixteen hundred and sixty dollars he being the highest and best bidder. Now for and in consideration of the sum of sixteen hundred and sixty dollars in hand paid to said John A. J. Spear, Administrator, as aforesaid by James Brown at and before the sealing and delivery of these presents (the receipt whereof is hereby acknowledged) said John A. J. Spear, Adm. as aforesaid, hath granted, bargained, sold and conveyed, & by these presents doth grant, bargain, sell and convey unto the said James Brown his heirs, executors, Administrators and assigns, the said lot of land to-wit; The north half of lot No. 177, according to the plan of survey except five acres as aforesaid in the fifteenth District of (originally Henry now) DeKalb County, containing by estimation eighty three acres, be the same more or less, with all and singular the rights, members and appurtenances thereunto belonging, or in any wise appertaining unto him the said James Brown his heirs, executors, administrators and assigns, to his and their own proper use, benefit and behoof forever in fee simple. IN WITNESS WHEREOF, the said John A. J. Spear, Administrator as aforesaid, hath hereunto set his hand and affixed his seal, the day and year first above written. Williams - Clerk S. C. NOTE: deeds for the two properties on lot 177 was in the center of action during the Battle of Atlanta where the Spear family lived at that time. The family was told by soldiers to leave. I do not know if Jesse Spear died during this time of shortly after. His estate in Jasper County was probated in 1866.
