Will of James Robertson 14 Aug 1876 DeKalb County, GA JAMES B. ROBERTSON State of Georgia DeKalb Co. August the 14th 1876, Know all men by these presents, that I, James B. Robertson of the state and county aforesaid do hereby make and ordain this my last will and testament revoking all others etc. in manner following, to wit: Item 1st. It is my will that all my just debts be paid as soon as practicable after my decease by my executor herein- after named. Item 2nd. I give and bequeath to my daughter Minerva Ragsdale and the heirs of her body one hundred acres of land being the south half of lot of land number (84) eighty four in the 16th district of originally Henry now DeKalb County valued to her at five hundred dollars in part of her legacy which I give to her and her heirs as above named and not subject to sale or payment of any debt or debts of her present husband or any future one which she may have. Item 3rd. It is my will and wish that my other children, Martha A. Lyon, Nancy Bailey, (Mary) S. Cook be made equal out of my estate with my daughter Minerva Ragsdale; also the children of my deceased son James A. Robertson to have said amount of five hundred dollars to be equally divided among them. Item 4th. It is my will that my grandson James D. Robertson have four hundred dollars in money (lawful currency of the country) paid to him by my executor hereinafter named, provided he shall live to the age of twenty one years, but in the event he should not attain to that age, then it is my will that said amount so willed to him be equally divided between my other children, which amount of four hundred dollars is the full distributive share which I leave to my said grand- son James D. Robertson. Item 5th. It is my wish that if my land can be divided between my children satisfactorily by laying it off in as equal lots as can be done by impartial judges and valued by good and impartial judges so as to give satisfaction, I wish it done, but in case that arrangement cannot be effected then it is my will that said lands except the portion willed to my daughter Minerva Ragsdale be sold by my executor and divided as directed in the third item of this my will. Item 6th. It is my will that all my property both real and personal be sold by my executor and after complying with each item in the preceding will, and should there be enough left, it is my will that my executor pay over to my grandson Josiah James two hundred dollars in the currency of the country and whatever amount then left if any thing be equally divided between my said daughters and the children of my deceased son James A. Robertson. Item 7th. I hereby ordain and appoint my trusty friend and son in law John J. Bailey executor to this my last will and testament hereby revoking all others. Robertson has departed this life, and did on the 14th day of August 1876 make a will as your petitioner alleges, conformable in all respects to the statute and appointed as executor thereof your petitioner-- and your petitioner desiring to prove said will in common form at the regular term of the court of Ordinary of said county to be held on the first Monday in January 1879-- Therefore prayeth that an order may be granted admitting said will to record as provided by law in such case. /s/ J.
