D. Newton, that William M Stokes did on the seventeenth day of November, in the year eighteen hundred and forty-one execute and deliver to J. D. Newton, a mortgage deed of a half acre lot or parcel of ground lying and being within the town of Bristol, and first district of Dooly county, and known and distinguished in the plan of said town as number twenty-nine, the better to secure the payment of his two promissory notes, the one dated upon the day and year aforesaid, and whereby the said J. D. Newton or bearer, by the first day of January, in the year eighteen hundred and forty-three, the sum of Six Hundred Dolloras for value received; the other bearing date upon the year and day first aforesaid, and whereby he promised, on the first day of January in the year eighteen hundred and forty-four, to pay the sum of Six Hundred Dollars for value received, to the said J. D. Newton or bearer. And it appearing to the Court, that the said mortgage deed was assigned by the said J. D. Newton to the said Robert Martin— It is ordered and adjudged by the Court, that the said William M Stokes pay into the Clerk’s Office at this Court, the full amount of principal and interest on said notes, on or before the first day of the next term of the Court, or shew cause in the contrary; and on failure thereof, the equity of redemption in and to the aforesaid Lot of Land, shall be forever barred and foreclosed; and that a copy of the Rule be served upon the defendant by publication once a month for three months before the next term of this Court.
