Library Written: August 4 1858 The Last Will and Testament of John Q Adams Georgia Dooly County To God the Father, God the Son, and God the Holy Ghost be all honor, praise and holiness forever more amen. I John Q Adams of said State and County being now about thirty nine years of age in the prime of life but weak feeble and infirm in body (having been sick for several days) and knowing that it is allotted once for all men to die and as all other men having no appointed time to live deem it right and proper both as respects my family and myself that I should make a disposition of the property which a kind and merciful providence has blessed me Do therefore make this my last Will and Testament herby revoking all others heretofore made by me. Item 1st I desire and direct when I come to die that my body be buried in a Christian like manner suitable to my condition and circumstances in life. My soul I hopefully and humbly trust shall return to rest and happiness with God who gave it as I hope for eternal salvation through the merits and atonement of the blessed lord and savior Jesus Christ. Item 2nd I desire and direct that after my death my executor herein after named sell enough of such property out of my estate as can be best sparred and without delay apply the proceeds to the payment of my just debts as I am unwilling my creditors should be delayed in their just rights that old Liby and two mules which I now own be sold to the best advantage and the proceeds applied to the payment of my debts. Item 3rd The remainder of all my property both real and personal I desire and direct to remain together and be taken care of to the best advantage by my Executors until any one of my children should become of mature age or marry so as to need its part. Then I desire and direct that it shall all be equally divided into five parts and the one fifth part be given to the child so of age or that has married and the other four parts to equally belong to my beloved wife Martha Jane Adams and the other three children and that the remaining three children ? be entitled to take each one its share as they become of age or marry as the first one above mentioned until they all get their several shares subject however to be kept together and managed to the best advantage by my Executors as aforesaid until the youngest or last child becomes of age or marries provided however that in case my said wife should have born to me another child after my death then and in that event I desire and direct my property to be equally divided into six equal parts instead of five as aforesaid and the one sixth part given to said child which may be hereafter born subject however to remain together as above stated and to be managed to the best advantage by my Executors as aforesaid. Item 4th The portion of property to which my beloved wife Martha Jane Adams will be entitled according to the provisions of the third item of this my will I desire and direct she shall enjoy for and during her natural life for her sole use and benefit and in case she should hereafter marry said property is not to be subject to the control disposal or debts of said husband. And at the death of my said wife Martha Jane then the portion so given to her is to go to my children which I have by her. Item 5th For the special trust and confidence which I have in my beloved Martha Jane Adams, Lewellen Mashburn, and Summer Adams I herby appoint them my Executors to carry out this my Will and empower them without any further order to do so to sell the lands on which I now live in case they should think it advantageous to the ? to do so and with the proceeds of the sale buy another plantation for my estate. Lock James M Dees Additional Comments: John Q Adams was born sometime in 1820 in Laurens County, GA. John is the son of Leven Adams and Winiford (Winny) Edwards. John Adams married Martha Jane Montford on December 16th, 1841 in Laurens County. They were married by the Justice of the Peace, James Lock. James Lock also happens to be John Adams’s brother in law.
