All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/ga/gafiles.htm ************************************************ Georgia Dougherty County I, Mrs. Lee Whidby of said state and county, being of sound and disposing mind and memory, do hereby make this my last will and testament, hereby revoking any and all others that I have heretofore made. ITEM 1 It is my will and desire that my body be buried in a Christian like manner, suitable to my condition and circumstanced in life, the details of which I leave to the discretion of my executor hereinafter names and appointed. ITEM 2 it is my will and desire that all of my just debts be paid as soon as practicable after my death and this I direct my executor to do. ITEM 3 I will, bequeath and devise to my daughter Betty, now Mrs. Robert Bacon, my diamond ring to be hers absolutely and in fee simple and to be delivered to her by my executor immediately after my death. ITEM 4 All the remainder and residue of my estate both real and personal and wherever situated, I hereby will, bequeath and devise to my children Lee Roy Whidby, Gordon Whidby, Betty (now Mrs. Robert Bacon), Evelyn (now Mrs. C. S. Yuell), Myrtle (now Mrs. G. C. Jones Jr.), share and share alike, subject to the conditions of this will. ITEM 5 I hereby invest my executor with the power to keep all of the real estate of which I might die seized and possessed together and intact if in his judgement this should be done for a period of not to exceed three years from the date of my death so that he may use the income from said real estate for the purpose of paying off any encumbrances that may be upon any part or parcel of said real estate at the time of my death. ITEM 6 I hereby give to my executor the right and power to sell any part of my said estate at any time that in his judgement it would be advantageous to the estate to do so and this he may do at either private or public sale and this he may do without order of any court. ITEM 7 My son, Lee Roy, having from time to time advanced to me certain sums of money for which I have given him my notes, it is my will and desire that he be paid the sums so advanced by him as soon as is practicable. ITEM 8 I hereby direct that if any of my children shall be indebted to each other at the time of my death that my executor withhold the distribution to such child or his or her share of my estate until such indebtedness be paid in full. ITEM 9 I hereby make and appoint my son, Lee Roy Whidby, executor of this my last will and testament, and I relieve him from making any inventory of my property or appraisement or from giving any bond and I further relieve him from making any return of his acts and doings to any court whatever, requiring him only by this will to probate the will as required by law. This 23rd day of February 1943 Mrs. Lee Whidby Declared, published, signed and sealed by Mrs. Lee Whidby as her last will and testament in the presence of the undersignedas witnesses, she first signing in our presence, and we then at her special instance and request, signing in her presence and in the presence of each other.
