All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/ga/gafiles.htm ************************************************ Georgia * Dougerty County * In the name of God, Amen * I, Richard Hobbs of said county and state, being of sound mind and memory do hereby make this my last will and testament, revoking all other wills heretofore made by me. Item 1st: I desire that my body be buried in a decent and Christianlike manner, and that all my just debts be paid as soon as possible. Item 2nd: I give and bequeath to my beloved wife Amie?** J. Hobbs and our children, now living or that may hereafter be born unto us, all my estate share and share alike, and appoint my said wife, Guardian of the persons and property of our children, without having to give bond and giving her the entire income of the estate without accountability, until our children either having ar arrive at the age of 21 years, when the estate shall be divided as near equally as possible, except the dwelling house and lot where the family of Mr. H. A. Tarver now resides, which shall remain as part of my estate during the life time of my wife's father and mother. Item 3rd: If my said wife should marry again or if either of our children should marry or become of age, then my desire is that the estate shall be divided equally between herself and our children share and share alike, She still retaining the Guardianship of the persons and property of such of the children as shall be underage or unmarried and for the care and management of the interests which may thus remain in her hands, she will then give the bond required by the laws of Georgia as such Guardian. This item is not to be understood as voicing any objective on my part to my wife marrying again, if she should desire but simply to provide for the pretection of the share of my estate going to the minor children. Item 4th: I hereby vest full power and authority in my beloved wife, who by this testament I conate? sole Executrix without being required to give bond, to bargain, sell and convey, any or all of my estate for such sums of money as she may be advised is right, without having to get the order of any Court whatsoever, the proceeds of said sale, or it's investment to be considered held and taken as part of my estate. She is also authorized to appoint her own successor by will as Executrix of my Estate and guardian of the persons and property of the minor children. Our Boy Richard is to have my watch and chain and as he is growing into years of maturity, and deserving of all confidence. I would prefer that he shall succeed my wife as Executor.
