Smith decd In the name of God, Amen. I W B Smith of the County of Effingham and State of Georgia being of sound and disposing mind and memory and being desierous of setling my worldly affairs, while I have strength to do so, do make and freely publish this my last Will and Testament, hereby revoking all wills heretofore by me mad, at any time whatsoever. And first I commit my soul to God who gave it; my body I desire to be decently interred, and my worldly estate I dispose of as follows. After paying all my just debts [note: the word debts is crossed through] liabilities, I give and bequeath to my beloved wife Mary Ann, all my estate, both real and personal, during her life time, or widowhood; and I further will that each of my children shall, at the time of their marriage, receive from my estate a bed and bedstead, with thirty Dollars. After my wifes death, I will my estate be divided, share and share alike, among all my children; the portion going to my beloved daughter, Georgia Ann Melissa, wife of Ephraim E. Kesler, to be in trust, for her and her children, and in no way whatever, subject to the debts, contracts, or control [note: double underlined], of her said husband, Ephraim E. Kesler; my two oldest sons, Littleton B. Smith and George W. Smith, to be trustees for my said daughter Georgia Ann Melissa Kesler, and should I and my wife both die before my said sons are of age, then Thomas A Flood and Jonathan Snider to be trustees for my said daughter, until my two oldest sons are of age, when they are to assume the trusteeship of her property. And I further will, that should my beloved daughter Georgia Ann Melissa Kesler, die childless, that her property return to her brothers and sisters. I hereby appoint Jonathan Snider and Thomas A Flood to be my Executors, on this my last Will and Testament. In witness whereof, I the said W B Smith, to this my last Will and Testament, have set my hand and seal, this twenty second day of June 1860 W. B. Smith as his last Will and Testament, in the presence of us, who, at his request, in the presence of each other, have subscribed our names as witnesses. Rahn F G Tebeau Ordinary State of Georgia Effingham county Before me Frederick G Tebeau Ordinary of said County, came in person, Jonathan Snider, Executor of the last Will and Testament of William B Smith, deceased, late of said County and also Augustus N Rahn, one of the subscribing witnesses to the said Will, who being duly sworn, deposed and says, that he saw William B Smith, sign, seal, declare and publish said instrument as his last Will and Testament, freely, voluntarily, and of his own accord, and without any influenge or compulsion whatever; that at the time of the execution of the said Will, said Testator was of sound disposing mind and memory; that deponent with William Speir senior, C F Rahn and J Seckinger, signed said Will as witnesses, in the presence of the Testator and at his special instance and request, and in the presence of each other, so help me God Aug N Rahn Sworn to, and subscribed before me, this 25th day of April 1866 F G Tebeau Ordinary E.C.
