He was the son of John and Agatha "Agnes" Henry. John Maxwell was the son of Rev. Thomas Maxwell and Mary Pemberton. Simeon married in Elbert Co., GA 9 Dec 1819 to Elizabeth Fortson, daughter of William Fortson and Ann Higginbotham. About 1833 Simeon and wife, and Simeon's brothers Benson and Reuben Maxwell, moved from Elbert Co. to Talbot Co., GA, and by the later 1830s Simeon and family had settled in Greene Co., AL where he had earlier received a patent for land. The children of Simeon and Agatha were: John (settled in TX); Augustus Emmett (1st wife Sara Brockenbrough, 2nd wife Julia Hawks Anderson), lived in Eutaw, AL and in Florida;Simeon Alexander, buried Panola Co., TX; Amanda (married Patrick Williams and settled in Louisana); Mildred (married William Foster and settled in Weatherford, TX; Josephine, died young; Elvira; Druscilla, moved to TX; and Deamarius (married Dr. Wills and settled in TX.)
