Deed Book Y, folio 91, transcribed by J.T.Rucker, Jr.: "Georgia, Elbert County) This indenture made and entered into this the twenfth day of August in the year of our Lord one thousand eight and thirty nine _____ Thomas Bryant, Persen Duncan sen. Leonard Rice Alice Deadwyler, Jesse Stathem, William Duncan, Aron Duncan Moses Duncan heirs and Legatees of the Estate of John Duncan late of Elbert County _____by Moses Duncan of the State and County aforesaid one of the managers of said deceased Estate of one part, and Thomas Haynes of said State and County of the other part witnesseth that for and in consideration of the sum of twelve hundred and ten dollars to them in hand paid by the said Thomas Haynes the receipt whereof is hereby acknowledged hath this day granted bargained and sold unto said Thomas Haynes his heirs and assigns a certain tract of land in said County on the North fork of the Beaverdam Creek, containing three hundred seventy acres (?)be the same more or less and bound as follows to wit, (viz) beginning at a Hicory corner on William C Rays corner struck South 16E 28 Ch. to a White oak corner, thence (N80E1 Ch. 50lks. to a White oak coner) thence 25 E 15 Ch. to a Post Oak coner, thence S 73 W.8 chains to the beginning Hicory corner - To have and to hold and to hold from us the above named heirs and legatees by our said manager Moses Duncan do covenant with said Thomas as follows 1st that we are lawfully seized of said property, 2nd that we have a good right to convey the same 3rd free from encumbrance 4th that the said Thomas his heirs and assigns quietly possessed the same forever in fee simple 5th that we well and truly warrant and forever defend the title of the above described tract of land free from the clain or claims of all person or persons whatever unto the said thomas Haynes his heirs Admrs Exrs and assigns forever. In witness whereof I the said Moses Duncan manager as aforesaid have hereunto set my hand and affixed my seal the day year first within written signed sealed and delivered in presence of David A Winn, Benjamin Winn J.P.
