Indenture between John Faulkner & Robert Hester 10 Jan 1854 Elbert Co, GA Superior Court Elbert County Deeds Book BB 1852-1857 Page 109 John Faulkner to Robert Hester, Mortgage Georgia, Elbert County: This Indenture made this the tenth day of January eighteen hundred and fifty four between John Faulkner of the County and State aforesaid of the one part and Robert Hester of the same place of the other part... Witnesseth that the said John Faulkner hath this day made and delivered to the said Robert Hester his certain promissory note under seal subscribed with his hand and sealed with his seal, and bearing even date with these presents whereby the said John Faulkner hath promised to pay the said Robert Hester or bearer two hundred and Eighty six dollars and eighty cents Ten days after the date of said note with Interest thereon from the first day of January instant for value received. Witness the hand and seal of the said John Faulkner. Now for and in consideration of the sum of five dollars by the said Robert Hester to the said John Faulkner in hand paid the receipt whereof is hereby acknowledged as well as for the better securing the payment of the aforesaid promissory the said John Faulkner hath granted bargained and sold and doth by these presents bargain sell and convey to the said Robert Hester his heirs and assigns all that tract or parcel of Land situate lying and being on the waters of Beverdam Creek in the Pike District in said County Joining Lands of Mrs. Rachel Richards, George W. Harmon, Mathew Pulliam and Edmund Rowsey containing one hundred and thirty acres more or less, it being a part of the Peter Shephard Survey and the tract whereon the said John Faulkner now lives. To have and to hold said bargained premises to him the said Robert Hester his heirs and assigns to his and their own proper use benefit and behoof forever....And the said John Faulkner for himself his heirs Executors and administrators the said bargained premises unto the said Robert Hester will warrant and forever defend against the claim of himself and his heirs and against the claim of all other persons whatever. Provided nevertheless that if the said John Faulkner his heirs Executors and Administrators shall and do well and truly pay or cause to be paid unto the said Robert Hester his heirs and assigns the aforementioned sum of Two hundred and eighty six Dollars and eighty cents on the day and time mentioned and appointed for the payment whereof in the said promissory note mentioned with Lawful interest for the same according to the tenor of said note, then and from thenceforth as well this present Indenture and the right to the property thereby conveyed as the said promissory note shall cease Determine (?) and be void to all intents and purposes....In testimony whereof the said John Faulkner hath hereunto set his and and seal this day and year first above written John (his x mark) Faulkner...[seal] Signed sealed and delivered in presence of Wm M McIntosh Amos L.
