Higginbotham of the other part, both of the State of Georgia and County of Elbert Witnesseth that the said William Fortson for and in consideration of the sum of one hundred and seventy five dollars to him in hand paid the receipt of which is hereby acknowledged have granted bargained sold ___ conveyed and confirmed and by these presents do grant, bargain, sell, ____, convey and confirm unto the said John S. Higginbotham his heirs or assigns forever all that tract or parcel of land lying and being in the county aforesaid adjoining Carters and others and containing seventy eight acres be the same more or less, which said lot of land was parted and divided to him in right of his wife Anne as one of the heirs of Samuel Higginbotham decd by order of the Honorable the Superior Court of said County, beginning at a stake corner on lot No. 5, thence N.75E9.36 to a stake corner thence N.15.W26.50 to a hickory corner thence N.75.E.29.36 to a dogwood and thence N.15.W.26.50 to the beginning stake which said tract of land is shown in the plat of the division of said land Lot No. Six, references being had to the division plat will more fully appear, the said William Fortson doth for himself his heirs and assigns covenant and agree with the said John S. Higginbotham that they shall have enjoy and posess the aforesaid tract of land forever in unmolested and quiet posession free from me my heirs and the claim and the claim of all every other person or persons whatever and I the said Wm Fortson do warrant and defend the right title and intrest of said land and premises unto the said John S. Higginbotham from my heirs and assigns forever from all and every person or persons whatever to __ land in right of my wife Anne, a legal heir of the said Samuel Higginbotham deceased, as aforesaid, all of which Right I hereby as aforesaid do bargain and sell and deliver unto him the said John S. Cook, J.P. ) Simeon Oliver ) Recorded 3rd July 1812 Additional Comments: William Fortson (1774-1846) married in Elbert Co. on 7 Aug 1794 to Ann Higginbotham (1772-1852). William was the son of Rev. Sol. Thomas Fortson, Jr. and Rachel Winn. William and Ann moved from Elbert Co. to Greene Co., AL and are buried in a family cemetery near Clinton, AL. They had 13 children.
