Indenture between Gideon Holmes & James Tiller 17 Aug 1844 Elbert Co, GA Elbert County Superior Court Deeds Book Z 1842-1847 Page 160 Holmes to Tiller Georgia, Elbert County: This indenture made the seventeenth of August Eighteen hundred and forty four between Gideon Holmes of the one part and James M. Tiller of the other part Witnesseth that the said Gideon Holmes for and in consideration of the sum of two hundred and fifty Dollars to him in hand paid by the said James M. Tiller the receipt whereof is hereby acknowledged hath granted bargained and sold and doth grant bargain and sell by these presents unto the said James M. Tiller his heirs and assigns a certain house and lot in the town of Elberton in the State and County aforesaid now occupied by the said Gideon Holmes as a dwelling bounded by the Road as it now runs leading from Young L G. Harris Law Office now occupied by Robert Hester and William M. McIntosh to Falling creek Meeting house on the east by fence as it now stands running from the draw barn on the Land to the dwelling house now occupied by Robert Hester and belonging to Henry Bowim (?) on the South by the garden fence as it now stands in the and by the street running east and west and passing by the jail on the North containing three quarters of an acre more or less to have and the house and lot together with all the appurtenances thereof unto the said James M . Tiller his heirs and assigns forever in fee simple and the said Gideon Holmes for himself his heirs and assigns will forever warrant and defend the aforesaid house and lot and every thing thereunto appertaining unto the said James M. Tiler his heirs and assigns against the claim of all persons whosoever in witness whereof I have hereunto set my hand and seal the day and date above written.
