Higginbotham of the aforesaid stated county of the other part Witnesseth that t he said Blackley Higginbotham hath bargained sold and delivered and by these presents doth bargain sell and deliver ____ and confirm unto the said John S. Higginbotham a certain tract or parcel of land situate lying and being in the county aforesaid and on the waters of Beaverdam Creek for and in consideration of the sum of one hundred and seventy five dollars to him in hand paid the receipt whereof is hereby acknowledged ____ and bounding as follows, to wit, beginning at Hickory on the old line known by Martin Turmans tract of which this tract or parcel of land is taken out of and assigned to the said Blackley Higginbotham by the men apointed by the Superior Court of this County to divide the real estate of Samuel higginbotham deceased late of this county and assign to each legatee his proportionable part and the said men did assign this lot known by number five in the said division and joining lot no. 4, and six as well appear by plot recorded in the clerks office of the Superior Court of this County to the said Blackley Higginotham on of the before mentioned legatees as his part including forty acres be the same more or less with all the reversions or reversions remainder or remainings ___ ___ ___to the only use and behoof of him the said John S. Higginbotham his heirs and assigns forever to have and to hold the said bargained land and ___ him and clear from all incumbrances whatsoever and from the lawful claim or claims of him the said Blackley Higginbotham his heirs or assigns and every other claim or claims whatever and that he the said Blackley Higginbotham ___ warrant and defend the same whereof he hath set his hand and seal the day and year above written in presence of us L.Garland Harris) Blackley Higginbotham (Seal) Wm. Samuel Higginbotham and Jane Satterwhite, married Mary Fisher (1800-1864) after moving from Elbert Co. to Wilcox Co., AL. They had 10 children. Both buried north of Camden, AL near Millers Ferry. Many descendants reside in Van Zandt Co., Texas.The John S. Higginbotham in the above deed was the older brother of Blackley.
