Higginbotham, 18 July 1811 The following indenture appears in Elbert Co. Deed Book O, page 51: "This Indenture made this 18th day of July in the year of our Lord one thousand eight hundred and eleven between Aaron Higginbotham of Warren County, state of Tennessee of the one part and John S. Higginbotham of Elbert County state of Georgia of the other part Witnesseth that the said Aaron Higginbotham for and in consideration of the sum of one hundred and seventy five dollars to him in hand paid at and before this sealing and delivery of these presents the receipt whereof is hereby acknowledged hath bargained sold released and confirmed and do by these presents bargain sell release confirm unto the said John S. Higginbotham his heirs and assigns one certain tract or prcel of land lying and being in the county of Elbert and state of Georgia on the waters of the Beaverdam Creek containing by estimation forty acres be the same more or less it being the amount in full of his legacy of the real estate of Samuel Higginbotham deceased as was divided by order of court some time in the year eighteen hundred and eight including the bounds laid off for the said Aaron Higginbotham which lies within the bounds of a two hundred acre tract deeded by Martin Turman to the said Samuel Higginbotham deceased lying in the county of Elbert which was granted to George Turman by the honorable John Hairston Captain General Governor and Commander in chief in and over the said state, on the twenty second day of September in the year of our Lord one thousand seven hundred and eighty four and by the said George Turman deeded to Robert Turman and by the said Robert Turman to George Turman son of Thomas Turman, and by him to Martin Turman, To have and to hold the aforesaid parcel of land lying within the bounds afore mentioned, and every part thereof, Together with all improvements and every appurtances thereunto belonging or in any wise appertaining unto the said John S. Higginbotham his heirs and assigns forever in fee simple, and the said Aaron Higginbotham do for himself his heirs assigns and every other person covenant and agree with the said John S. Higginbotham his heirs and assigns ____will warrant and by these presents forever defend the aforesaid parcel of land from all and every other claim and demand unto the said John S. Higginbotham and his heirs and assigns to his and their own proper use and behoof - In Witness Whereof I do hereunto set my hand and seal the day and year first above written. Fortson J.I.C Recorded 16 July 1812" [Submitter's notes: Aaron Higginbotham, John Satterwhite Higginbotham, Blackley Higginbotham and George Green Higginbotham were sons of Samuel Higginbotham.
