All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/ga/gafiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Transcribed by Chandler Eavenson 4 June 2006 Deed Andrew Hambleton (Hamilton) to heirs of Samuel Higginbotham 16 April 1805 The following deed appears in Elbert Co., GA Deed Book J, pages 195-197: "Georgia, Elbert County - This indenture made this sixteenth day of April eighteen hundred and five and in the twenty ninth year of American Independence between Andrew Hambleton and Jenny his wife on the one part and Jane Higginbotham, John S. Higginbotham, Samuel Higginbotham, Aron Higginbotham, Blackley Higginbotham, George Green Higginbotham, Clary Higginbotham, George Turman in right of his wife Violette, William Fortson in right of his wife Ann, and Clabourn Sandridge in right of his wife Jane, heirs of Samuel Higginbotham deceased of the other part Witnesseth that the said Andrew Hamilton and Jenny his wife for and in consideration of the sum of eight hundred and fifty seven dollars to them in hand paid the receipt whereof is hereby acknowledged before the sealing and delivery of these presents have granted bargained sold released and confirmed and by these presents do grant bargain sell release and confirm unto the aforesaid heirs of the said Samuel Higginbotham deceased and their heirs and assigns all that tract or parcel of land situate lying and being in the county and State aforesaid on Beaverdam Creek containing three hundred acres by the same more or less bounded by Thomas Carter's land and on all other sides by vacant land it being the tract of land on which said Samuel Higginbotham deceased lived in his life time which said tract of land was granted to the said Andrew Hamilton on the 21st day of September 1781. Together with all the rights members apperturnances thereunto belonging or in any wise appertaining To have and to hold the said tract of land with its appertinances to the only proper use benefit and behoof of them the aforesaid heirs of the said Samuel Higginbotham deceased and their heirs and assigns forever in fee simple as tenants in common and not as joint tennants and the said Andrew Hamilton and Jenney his wife for themselves and their heirs the aforesaid tract of land with its appertenances to the aforesaid heirs of the said Samuel Higginbotham deceased and their heirs against the claim of them the said Andrew Hamilton and Jenney his wife and their heirs and against the right title claim or demand of all and every other person or persons whatsoever shall and will warrant and forever defend. In testimony whereof the said Andrew Hamilton and Jenny his wife have hereunto subscribed their names and affixed their seals the day and year first above written. Andrew Hamilton (Seal) Jenny Hamilton (Seal) Signed Sealed and delivered In presence of Us Ro Thompton JP George Matthws, Junr Jenney Hamilton signed in presence of Kitty Hamilton Jenny Hamilton being examined apart from her husband Andrew Hamilton acknowledged and declared that she signed sealed and delivered the above deed freely and voluntarily and that she was not induced thereto by the coersion of her husband but that she doth herein and hereby freely and voluntarily reqlinquish all her rights of Dower of in and to the said tract of land this second day of December eighteen hundred and five.
