Elbert County }

Know all men by these presents That I David Staples of the County and State afd
for divers good causes to me moveing, do give grant Devise and bequeath, unto my
beloved Son, Thos Staples, at my death and the Death of my wife Fanney, all that
Tract or parcel of Land Situate Lying and being in the County afd on Shoal Creek
Where I now Live adjoining Lands of Whitead Hendricks, South, Elexandria Henry
East, Lands of Edmond Smithwick North and Lands of John Burnett West & South
Contain[in] Three Hundred and Sixty Acres Be the same more or Less, provided on
Conditions that my Beloved Son Thos Staples do Live with me, or near me And will
attend to all my Business agricultural as well as all other Business that I may
want attended to, during the Natural Life time of myself and my wife Fanney
Staples, then this Deed to be good in Law In fee simple, an the failer (sic) of
my son Thos Staples to attend to my Business during my Natural life and my wife
Fanney Staples then the above Indenture to be void given under my hand and Seal
this 28th Nov 1818

Personally came before me C.W. Christian & being duly sworn deposeth & saith
that he this deponant was a subscribing witness to the within instrument & that
he deponant saw David Staples sign seal & deliver the same and deponant saw
Jacob Coker & David Denney subscribe also as witnesses to the same sworn to &
subscribed before me this 15th April 1847.
