Cancellation of Richard Tyner Land Grant 24 May 1811 Elbert County, GA

                              Milledgeville 24th February 1812

     Hugh McDonald, Esquire of the County of Elbert attended and
presented a grant issued on the 24th day of May 1811 in the name
of "Richard Tyner" for twenty five acres of land in Elbert County
and stated that the said grant must have been issued by mistake
as he then had in his possession a grant for the same tract of
land issued on the 23rd day of November 1809 in the name of
Joshua Carpenter which said grant he also produced by which it
does appear that the two grants above mentioned are for the same
tract of land and on examining into the causes of the said error
it appears that it was a mistake which originated in the Surveyor
Generals Office by issuing a plat for the last grant and
inserting the name of Richard Tyner therein this mistake instead
of issuing a plat for a tract of four and a half acres of land in
Elbert in the name of Richard Tyner, the one at that time
intended to be applied for or wanted. In order, therefore, to
correct the preceeding
     IT is ordered that the first mentioned grant issued on the
24th day of May 1811 in the name of Richard Tyner for twenty five
acres of land in Elbert and now produced by the said Hugh
McDonald be cancelled and filed in this office, that the record
thereof, in the Office of the Secretary of the State be effaced
or obliterated and that a copy of this order attested by one of
the Secretaries of this Department be pasted or fixed on the page
so effaced or obliterated in order that the cause for so doing
may be known.
