Crawford Judge of the Superior Court now sitting, in and for Elbert County State of Georgia Benjamin Brown a resident of Elbert County and State of Georgia aged seventy years and a few months, who being first duly sworn according to law, doth, on his oath, make the following declaration, in order to obtain the benefit of the Act of Congress passed June 7th 1832. That he entered into the service of the United States under the following named officers, and served at different periods as herein stated: That he volunteered into the service of the United States for three months in the County of Wilks State of North Carolina, then the place of his residence on the ___ day of ___ in the year one thousand seven hundred and eighty, under Captain William Lenoar, Commanded by Colonel Cleveland, rendezvoused at Wilks Court House in the State of North Carolina marched from there to Ramsours Mills, from thence down the Yadkin River in the State of North Carolina, where he was discharged after having served three months as a private in the United States Service, that he served with no other troups except the Militia during this tour of duty, and that he does not recollect the day and month when he was discharged. That also he substituted into the service of the United States for three months as a private for one John Wall in the county of Wilks State of North Carolina, then the place of his residence, on the __- day of ___ in the year one thousand seven hundred and eighty, under Captain Paul Patrick, sometimes commanded by Colonel Armstrong and at other times by Colonel Isaacs, marched from Wilks County to Fishing Creek in the State of South Carolina, and there was attacked by the British Commanded by Colonel Tarleton, (the American Troops was under the immediate command of General Sumpter) in the month of August Seventeen hundred and eighty, the whole of the detachment was either killed, captured or dispersed, Went from thence to Hillsborough North Carolina where he was discharged in the year seventeen hundred and eighty but does not recollect the day or month, after having served three months in the service of the United States, and that he does not recollect that he served with any other Troops except the Militia during this tour of duty. That he also Volunteered as a private for three months into the service of the United States, in the County of Wilks, State of North Carolina then the place of his residence, on the ___day of ___ Seventeen hundred and eighty under Captain David Vias in a Regiment commanded by Colonel Cleveland, marched from Wilks County to Kings Mountain in the State of North Carolina, and on the seventh October seventeen hundred and eighty, attacked the Loyalist commanded by Major Ferguson on the top of the mountain, after the battle marched the prisoners taken at that place, to the Moravian Town in the State of North Carolina where he was discharged after having served three months as a private in the service in the year Seventeen hundred and eighty, the month or day of his discharge he does not distinctly recollect, and that he served during this tour only with the Militia and Volunteers commanded by Colonels Cleveland, Lacy, Campbell, Shelby, Sevier, McDowell, Hathhorn and Hill. That he also substituted into the service of the United States as a private for three months for one William Cochran, in the County of Wilks State of North Carolina, then the place of his residence on the ___ day of ___ seventeen hundred and eighty one under Captain John Cleveland, commanded by Colonel Benjamin Herndon, rendezvoused at one Major Lewis in the State of North Carolina, marched from thence to the old trading ford on the Yadkin River near Salisbury in the State of North Carolina, where he remained stationed until the expiration of his service and was discharged at that place in the year seventeen hundred and eighty one after having served three months as a private in the service of the United States the day or month when he was discharged he does not at this late date recollect and that during this Tour he served only with his own Regiment. That he also was drafted into the service of the United States as a private for three months, in the County of Wilks State of North Carolina then the place of his residence, on the ___ day of ___ in the year Seventeen and eighty one, under Captain John Morgan in a Regiment commanded by Major Hartgrove marched from Wilks County to Hillsborough No. Carolina where he remained two months, then was disbanded and sent home with orders to hold himself in readiness when called on, and that during this Tour of duty he served only with Regiment, making in all at the different periods fourteen months service as a private in the service of the United States during the Revolution, That he has no documentary evidence, and that he knows of no person, whose testimony he can procure, who can testify to his Service as a soldier of the Revolution. That he was born in Orange County State of Virginia on the seventeenth day of February in the year of our Lord one thouseand Seven hundred and sicty three, and has a record of his age now in his possession which was kept by his Father, that when called into Service he lived in Wilkes County State of North Carolina, and that he lived in Wilks County State of North Carolina a short time after the Revolutionary War, then removed to Wilkes County State of Georgia, now Elbert County, formed out of Wilkes County, and has resided there ever since, and now resides there. That he entered the service the first tour as a Volunteer, the second tour he substituted for one Jonathan Wall, the third tour he Volunteerd into service, the fourth tour he substituted for one William Cochran, the firfth tour he was drafted into the service of the United States, That he served with no Regular officers, or Continental Regiments only with the Militia Regiments which has been before stated in this declaration, the general circumstances has already been before stated in the foregoing delcaration, That he received no written discharges for any of his services during the Revolutionary War, they were all verbal, or disbanded from service. He states that the names of the persons to whom he is known in his present neighborhood, and who can testify to his character for veracity, and their belief of his sevices as a soldier of the Revolution are the Hororable Wiley Thompson late a member of Congress, George Cook, Leroy Upshaw, Benajah Houston, George Wyche, and General James M. Tait. He hereby relinquishes every claim whatever to a pension or annuity except the present, and delcares that his name is not on the pension Roll of the Agency of any State, Sworn to, and Subscribed the day and year aforesaid (SIGNED) Benj Brown In open court, Benajah Houston, Clerk S.C.E.C. (Superior Court Elbert County) We Peter P. Butler a Clergyman, residing in Elbert County State of Georgia, and Benajah Houston residing in the same place, hereby certify that we are well acquainted with Benjamin Brown who has subscribed and sworn to the above declaration, that we believe him to be seventy years of age; that he is reputed and believed in the neighborhood where he resides to have been a soldier of the Revolution, and that We concur in that opinion. Sworn to, and subscribed, the day and year aforesaid (SIGNED) Peter P. Buter; Benajah Houston Test: Benajah Houston, clerk, in Open Court And the said Court do hereby declare his opinion, after the investigation of the matter, and after putting the interogatories prescribed by the War Department, that the above named applicant was a Revolutionary Soldier, and served as he states, And the Court further certifies, that it appears to them that Peter P. Butler who has signed the preceding certicate is a clergyman, resident in Elbert County and State of Georgia, and that Benajah Houston who has also signed the same, is a resident, in the same place, and is a creditable person, and that their statement is entitled to credit. Court, Elbert County, GA (Seal stamped) (Notated on cover: Amended declaration of Benjamin Brown for a Pension) Additional Information: The transcript of the Pension Application and the following information was provided by a descendant Mrs. Ann C. Holloman: Benjamin Brown was born on 17 Feb 1763 in Orange Co., VA, died on 27 Feb 1846 in Elbert Co., GA and is buried on the family farm there. He had married a wife Nancy by 1785 and she was his wife on 22 Nov 1799 when Benjamin and Nancy Brown deeded land in Elbert Co. (Deed Book F, page 85) He married on 3 Apr 1823 in Elbert Co. to Mrs. Prudence Richardson, widow of Walker Richardson. (See Elbert Co. Will Book M, page 302, estate of Walker Richardson, showing a receipt of William N. Richardson, son of Walker Richardson, reading "except my portion willed to my mother, wife of said deceased, now the wife of Benjamin Brown.") By 14 Mar 1835 he was married to Joanah (widow of Thomas Gregg) as per Elbert Co. Deed Book W, page 162, where Joanah was mentioned as his wife. She was also named Joanna in his Will dated dated 28 Jan 1843 (Elbert Co. Will Book 1835- 1860, page 90). His first wife Nancy died on 14 Oct 1821 at age 58 years and 8 days, as per a record in the Family Bible of his son Dozier Brown.
