S/ James Dillard Sworn to before me this 18th of October 1819. S/ John M. Dooly, J. S. C. State of Georgia, Elbert County On this 11th day of September 1820 personally appeared in Open Court being a Court of record for said State & County, James Dillard aged about sixty years resident in said County & State aforesaid who being first duly sworn according to Law, doth on his oath declare that he he served in the Revolutionary War as follows (to wit) as a private in a company commanded by Captain Alexander Prevard [sic, Alexander Brevard] attached to the Regiment commanded by Colonel John Armstrong of the North Carolina Line as appears by his Original declaration dated the 18th day of October 1819 that he has received a pension Certificate Showing a number (16, 100) but has not yet received any money as a pension. And I do solemnly swear that I was a resident Citizen of the United States on the 18th day of March 1818 and that I have not since that time by gift sale or in any manner disposed of my property or any part thereof with intent thereby so to diminish it, as to bring myself within the provisions of an act of Congress entitled an act to provide for certain persons engaged in the land & naval Service of the United States in the A revolutionary War passed on the 18th day of March 1818. And that I have not nor has any person in Trust for me any property or securities, contracts, or debts due to me, nor have I any income other than what is contained in the Schedule hereto annexed and by me Subscribed Viz 200 acres of Land 3rd quality $400.00 50 acres of the above Land in dispute which is forest Land & the most Valuable. My wife about 56 years of age capable of doing of the Business that persons of her age & sex are Ordinarily able to do – and I do further solemnly swear that I am in debt necessarily for the Support of my Family & have no other means of Extricating myself therefrom other than as Exhibited above. [On December 4, 1843, Sarah Dillard filed in Elbert County for a widow's pension stating, inter alia, that her husband died April 4, 1839; that they were married on January 14, 1788 by the Rev'd John Newman, a Baptist minister, in Surry County, NC. She attached what appear to be pages from the family's Bible on which birth records are recorded but they are largely illegible. In a typed abstract of her application prepared by the War Department, the Bible information is transcribed as follows: Elizabeth Emaly born October 14, 1788 Nancy July 28, 1793 Mary Varnon October 3, 1795 Jinse August 25, 1797 James July 13, 1799 Sarah Joice March 22, 1801 Sidney September 23, 1802 Nehemiah Varnon September 4, 1805 Isaac March 27, 1807 Martha Matilda October 27, 1808 Thomas Mosser May 30, 1811] [On February 20, 1828, James Dillard filed another application under the 1818 and 1820 acts. This application is substantially identical to the one filed in 1820 except the amount of his property is reduced to being valued at $265.50. In this application, claimant gives more details on his family.] State of North Carolina, Secretary's Office 23rd of November 1819 I William Hill Secretary of State in & for the State aforesaid, do hereby certify that it appears from the Muster roll of the Continental line of this State in the Revolutionary war, that James Dilliard [sic] a private in Captain Brevard's Company of the 10th Regiment was mustered in 1781 for 12 months and that he left the service the 9th May 1782. Given under my hand the date above. S/ Wm Hill Georgia, Elbert County Before me John M. Dooly One of the Judges of the Superior Court of said State, personally appeared William Faulkner, who being duly Sworn saith that James Dillard of Said State & County enlisted in the war of the Revolution on the Continental Establishment for the term of 12 months & that he Served his Country for & during that term – and further this deponent sayeth that the said James Dillard is now Old & infirm & incapable of laboring for the support of himself & family & that a knowledge of his reduced circumstances has frequently induced this deponent with others of the neighbors & friends of the said James Dillard to continue to his (the said James') Support. Sworn to & subscribed before me 18th of October 1819. S/ Wm Faulkner S/ John M. Dooly, J. S. C. NOTES: James Dillard, Sr. married Sarah (Varnon/Vernon??) in Surry Co., NC on 14 Jan. 1788. They were married by the Rev. John Numan, Minister of the Soapstone Baptist Church in Surry Co, NC. He had bought land on Buffalo Creek in Surry Co. NC. James Dillard, Sr. died on 4 April 1839. His obituary was published in The Christian Index on 2 May 1839, col. 1. The obituary stated that he was 77 years old which would make him b. ca 1762 instead of 1760 as he stated in his Pension Application. I suspect that 1760 is the more reliable date since it was given by the pensioner himself. He left a will in Elbert Co., GA in Will Book Vol. B-C, 1835-1919, Ord. Ct., p. 33, m/film reel no. 73/42. His sons, James Dillard, Jr. and Nehemiah V. Dillard had predeceased him. James and Sarah Dillard's children were: Elizabeth Emaly b. 14 Oct 1788 in Surry Co., NC. She m. Richard Hilley Nancy b. 28 Jul 1793 in Surry Co., NC. She m. a man named Brawner Mary Varnon b. 3 Oct 1795 in NC, d. 18 Oct 1863 in Newton Co., GA. She m. John Almand, Sr. on 20 Jan 1820 in Elbert Co., GA Jane (Jinse) b. 25 Aug 1797 in Elbert Co., GA. She married her dead sister's husband William D. Campbell on 21 Oct 1839 in Elbert Co., GA. James, Jr. b. 13 Jul 1799 in Elbert Co., GA, died before 4/1839 Sarah Joice b. 22 Mar 1801 in Elbert Co., GA. She m. William D. Campbell on 25 Oct 1820 in Elbert Co., GA. She died 29 Mar 1839 in Elbert Co., GA. Sidney (Cindy) b. 23 Sept 1802 in Elbert Co., GA Nehemiah Varnon b. 4 Sept 1805 in Elbert Co., GA., died before 4/1839 Isaac Newton b. 27 Mar 1807 in Elbert Co., GA. He m. Sarah J. Stephens on 24 Feb 1834 in Oglethorpe Co., GA. He died 19 Feb 1885. Martha Matilda b. 27 Oct 1808 in Elbert Co., GA. She m. Samuel N. Scott on 27 Dec 1832 in Elbert Co., GA.
