Booth vs James Carter Booth re: Estate of John Booth) Minutes Elbert County Court of Ordinary, March 22, 1886 GEORGIA, ELBERT COUNTY: To the Ordinary of Said County: The petition of A. J. Booth, of Clark County, Georgia, respectfully showeth that James Carter Booth, Executor of John Booth late of said County deceased is mismanaging the Estate of said deceased, by refusing to pay the just debts of said deceased, and also the legacy bequested to this legatee in and by his last will and testament and by fraudulently depriving said creditors and legatees of their rights. Your petitioner further showeth that said James Carter Booth was qualified as ___ (unreadable) executor the year 1874 and at the time in which he should have paid said debts and legatees as required by law has long since expired. Your petitioner further showeth that said J. Carter Booth is insolvent and that the creditors and legatees of said deceased, are in danger of losing their debts and legacies unless James Carter Booth is required to give bond and security as such executor. Your petition further showeth that he is one of the legatees of said deceased and also one of his creditors and that said executor has refused and still refuses to pay your petitioner the debt and legacy due him from said estate though often_______(unreadable) requested. Therefore your petitioner prayeth that said James Carter Booth be cited to appear before your Honor on such day as your Honor may fix to show cause why he should not give good and approved security as herein aforesaid and in default there of that his letters testamentary as mentioned aforesaid be revoked. J. Booth to require J. Carter Booth executor John Booth's estate to give bond and security for certain grounds in said petition stated shows sufficient reason for granting the rule in said petition prayed for. It is therefore ordered that a copy of said petition and this rule be served on said J. Carter Booth ten days before the April term 1886 of this court and that he show cause at said term, if any, he can, why he should not be required to give bond and security as prayed for. Geo. April 5, 1886 George L Almond, Ordinary. -- A J. Booth vs J. C. Booth. A.J. Booth admin John Booth decd: Suit on account in Elbert Superior Court to March Term 1876. Verdict for Plaintiff for Three Hundred dollars principal with interest and costs by Consent of Counsel reduced to Two Hundred dollars principal with interest and costs. Whereupon it is ordered considered and adjudged that Plaintiff A. J. Boothe do recover of defendants J. C. Boothe and A. J. Boothe as administrator of John Boothe deceased the sum of two hundred dollars principal and the sum of six dollars costs of suit with interest on said principal from March 12, 1876, said sums to be levied of the goods and chattels lands and tenements of John Booth deceased in the hand of said A. J. Boothe and J. C. Boothe a _______(unreadable) to be administered.
