Will Book 1835-1860, Page 90 Written: January 28, 1843 Recorded: March 2, 1846 State of Georgia, County of Elbert: In the name God Amen: I, Benjamin Brown of the State and County aforesaid being in good health and sound mind and memory and calling to mind the mortality of my body and knowing that it is appointed for all men once to die do make and ordain this instrument of writing as my last Will and Testament, which is as follows: First: I give and bequeath unto my wife Joanna Brown one lot of land lying and being in the County of Union and state of Georgia known by number One Hundred and Fifty-Five (155) in the tenth district first Section. Also one gold lot by and being in the Fourth district and first section number Four Hundred and Eighty-Eight, county not recalled. Also one Negro man named Peter and one Negro Woman named Patsy and her three children named, Willis, Tom and Ben together with all the household and kitchen furniture which she had when I married her (i.e.) the negroes and furniture she now has in her possession. Second: I give and bequeath unto my Daughter Lucy Crawford Three Hundred Acres of land where she is now living and a negro man named Jack (a malatta). Third: I give and bequeath unto my grandson Benjmain Brown (son of Dozier Brown) Two Hundred and Fifty acres of land including where he is now living it being a part of the tract of land I am now living on. Fourth: I give and bequeath unto my son Dozier Brown the remainder of my lands lying on Savannah River (after Lucy Crawford and B. Brown has got their amount laid off to them) including my mansion house and improved part of my plantation with the Ferry and Fishery supposed to contain Two Hundred acres be the same more or less. It is my will that all my Negros remaining be divided into eight lots as near equal as can be in value (by Three disinterested men to be named by my Executor) and divided by lot among my seven children, and the children of Jincy White, Dec'd, viz. To Rosanna Hall one lot to Dozier Brown one lot to Lucy Crawford one lot to Asa A. Brown one lot to Elbert Brown, one lot to Nancy Herdon one lot to Matilda H. Davis, one lot and to the children of Jincy White dec'd, viz: Benjamin B. White, William H. H. White, Elizabeth Ann Crawford, Matilda Frances McDonald one lot. The said lots of negroes to be valued and those drawing the lots of highest value shall pay to those drawing lots of less value the difference in the value in cash so that their shares may be equal. The balance of my estate both real and personal be sold and the money arising therefrom be divided equally begtween my seven children and the children of Jincy White, dec'd. And I do hereby nominate and appoint my friends William W. White, William B. Sadler and my son Elbert Brown Executors to execute this my last Will and Testament and I do hereby revoke all former Wills by me made. Jones Lewis Scales James W. Jones GEORGIA, Elbert County, Court of Ordinary, March Term, 1846. Personally came into open Court James W. Jones and being sworn saith that he was present and saw Benjamin Brown sign the annexed instrument of writing as his last Will and Testament and that he deponent together with Solomon S. Jones and Lewis Scales signed the same as witnesses in the presence of the testator and at his request and in the presence of each other and this deponent believes the testator to have been of sound mind at the time of executing the same. Additional Comments: The transcript of Will and following information provided by a descendant Mrs. Ann C. Holloman: He was born on 17 Feb 1763 in Orange Co., VA, died on 27 Feb 1846 in Elbert Co., and is buried on the family farm in Elbert Co. He had a wife Nancy by 1785 and she was his wife on 22 Nov 1799 when Benjamin and Nancy Brown deeded land in Elbert Co. (DB F, pg.85). He married on 3 Apr 1823 in Elbert Co. to Mrs. Prudence Richardson, widow of Walker Richardson (See Elbert Co. Will Book M, page 302, estate of Walker Richardson, showing a receipt of William N. Richardson, son of Walker, reading "except my portion willed to my mother, wife of said deceased, now the wife of Benjamin Brown") By 14 Mar 1835 Benjamin was married to Joanah (widow of Thomas Gregg), as per Elbert Co. Deed Book W, page 162, where Joanah was mentioned as his wife. His wife Nancy died on 14 Oct 1821 at age 58 years and 3 days, as per the Family Bible of his son Dozier Brown.
