To John G Deadwyler State of Georgia ] This Indenture made this twenty first day Elbert County ] of September Eighteen Hundred and Sixty Eight, Between Thomas H Brown of the State and County aforesaid, duly constituted Administrator of the Estate of Jesse Brown, late of said County, deceased, of the one part and John G Deadwyler, of the same place of the other part, Witnesseth, that whereas by virtue of an order granted by the Ordinary, (previous notice of application having been given in the Elberton Gazette Newspaper, published in the town of Elberton, according to law, in such Case made and provided on the first Monday in July last) to said Thomas H Brown, Administrator as aforesaid, to sell a tract of land belonging to the Estate of said deceased, Situate, lying and being in the County aforesaid, on the waters of Doves Creek, containing two hundred and fifty-eight acres more or less, joining lands of Adkin Oglesby, Clayborn Webb, John T.Ridgeway and Francis Elberhart. After the said tract of Land was duly advertised, in conformity - to law the same was put up and exposed to sale, to the highest and best bidder at the door of the Court House at Elberton, in said County, within the legal hours of sale, on the first Tuesday in September last past, by said Thomas H. Brown, Administrator as aforesaid, when said tract of land was knocked off to said John G.Deadwyler, at the price and sum of Six Hundred and Forty Dollars. Now, for and in consideration of the said sum of Five Hundred and Forty dollars, cash in hand paid to the said Thomas H Brown Administrator, as aforesaid, by him, said John G Deadwyler (at and before the sealing and delivery of these presents, the receipt whereof is hereby acknowledged,) said Thomas H Brown Administrator as aforesaid, hath granted, bargained and sold, and by these presents, doth grant bargain and sell, (so far as the office of Administrator authorize him,) unto the said John G Deadwyler his heirs and assigns, the said tract of land on Doves Creek in said County, containing two hundred and fifty- eight acres, more or less, with all the rights, members and appurtenance trusts belong or in any wise appertaining; to him, said John G.Deadwyler, his heirs and assigns, in as full and ample, manner as said tract of land was (page 391) Seized, possessed and enjoyed by the said Jesse Brown, deceased, in his lifetime. In witness whereof, said Thomas Brown, Administrator, as aforesaid hath hereunto set his hand and affixed his seal, the day and year above written. B Tate Jr Clerk Note-The Executors of John G.Deadwyler sold this property on the 5th day of September 1871 to Francis Gaines, described as the Brown and Sims tract located on the waters of Doves Creek, containing three hundred and sixty four acres more or less, joining land of Joseph P.Deadwyler, Joseph Sewell and others. Recorded in Deed book FF pages 530 & 531. Plat recorded in Deed Book HH page 167. Plat shows land joins R.Ridgeway, J.S.Norman, Estate of F.B.Elberhart, Estate of A.Oglesby, R.H.Oglesby and J.P. Deadwyler and containing 392 9/10 acres. Plat was made Dec.14th 1884.
