Will of Joshua Cook 17 Jul 1822 Elbert County, GA In the name of God, Amen. I, Joshua Cook of the state of Georgia, County of Elbert, knowing that it is appointed for man once to die, and also being in a low state of health, but sound of mind and memory, do make this and this only my last will and testament in manner and form as follows: I wish first of all that my just debts be paid. Item the 1st: I will to my oldest son John one dollar in addition to what I have already given him. Item: I will to my daughter Elizabeth Patterson one dollar in addition to what I have already given to her. I will to my son Benjamin Cook one dollar in addition to what I have already given him. Item: I will to my daughter Mary one good horse, saddle and bridle, 1 feather bed and furniture, 1 cow and calf, 1 trunk and spinning wheel, and 1 pair cotton cards to her and her heirs and assigns forever when she should become of age or marry. Item: I will to my youngest son Elijah Mosely Cook 1 good horse, bridle and saddle, 1 feather bed and furniture, one cow and calf, 1 trunk to him, his heirs and assigns forever, at and after the time of his becoming of age or marrying. Item: I will to my loving wife Sarah Cook during her natural life all the land whereon I now live, with all my stock of all kinds (vis) horses, cattle, sheep, hogs, geese, chickens and turkeys, etc. with also the crop that is now made and growing also all waggon gear, wagons, plantation tools, household and kitchen furniture or as much or such as she thinks most proper to keep or at her proper disposal during her natural life, out of which I wish my youngest son Elijah Mosely schooled and raised. I also leave with my wife Sarah Cook all money, notes, bonds, and demands for her proper use as before mentioned during her natural life. Item: I will that after the death of my loving wife Sarah Cook, that my youngest son Elijah Mosely should have the land whereon I now live. Also a Negro boy named (Dick?) or the redemption money arising from him due should he be redeemed according to an instrument of writing between Charn__ and myself to that effect. I further will that after the death of my loving wife that all other properties not named in this will then remaining (vis) horses, hogs, cattle, sheep, geese, and waggon gear, wagons, machinery, plantation tools, household and kitchen furniture, money, notes, dues and demands should then be equally divided between my daughters, Elizabeth Patterson and Mary Cook, and I do appoint my oldest son John Cook and my wife Sarah Cook executors to this my last will and testament, and I do by these presents acknowledge this and this only to be my last will and testament, making void all former wills, ratifying and confirming this and this only in witness whereof I do hereunto set my hand and seal this 17th day of July in the year of our Lord 1822. /s/ Joshua Cook Test: James Bell, Smith Cook, Jesse M. Cook subscribed their names as witnesses to the same, all in the presence of each other, and in the presence of the said testator and at his request.
