Will of Charles Cosby 10 Mar 1800 Elbert County, GA I, Charles Cosby of the County of Elbert & State of Georgia do make this my last Will & Testament in manner & form following that is to say - Imprimis I give unto my wife Elizabeth Cosby during her natural life or widowhood the tract of land on which I now live also my Negroes Tab, George, Cennis, Belly, James, Jimus, Thornton, Jack, Lucy, Hannibal, Mariah, Malinda, & Charity. Together with all my stock of every kind & household furniture and after my wifes death or marriage my will is that the property already mentioned be disposed of as follows. Viz I give my granddaughter Lucy Cosby Harvy my Negro Boy Hanibal to her and her heirs for ever I give unto my granddaughter Elizabeth Sydner Harvey my Negro Girl Chorrity to her and her heirs for ever. But in case either of my above mentioned granddaughters Lucy C. Harvey or Elizabeth S. Harvey should die before they marry or come of age, then the legecy to go to the surviving sister of them. 3 I give unto my granddaughter Matilda Hall Andrew my Negro boy Antony now in the possession of her father to her and her heirs for ever. But in case my said granddaughter should die before she comes of age or marrys then my will is that my said Negro Antony should go to my Granddaughter Lucy Garland Andrew to her and heirs for ever and my will further is that the sum of twenty dollars be paid to the said Lucy Garland Andrew by my Executors. So soon as the same can be conveniently made out of my Estate. 4 And also I give the said sum of twenty dollars to my Granddaughter Elizabeth Sydner Cosby my Son Fortunatus daughter. 5 I give unto my son Robert Cosby two hundred and sixty one acres of land adjoining the place on which I now live & known by the name of Ishams place to him & his heirs for ever. 6 I give to my daughter Patsy Ragland my negro woman called Lucy now in her possession But in case she should die without lawfull issue my will is that the said Negro to go to my heirs general as hereafter directed. 7 I give to my daughter Barbara Miner Cosby my negroes George, Tab, Belly, Jimus, James & Mariah also one horse & saddle with one bed and furniture to her and her heirs for ever. 8 I give to my Granddaughter Lucy Hawkins Cosby my Negro girl Melinda to her and her heirs for ever. 9 I give to my sons Richmond, James, David, & Charles Scott the tract of land on which I now live. Also my Negroes Thornton, Denis & Jack together with my stock of every kind & all my household & kitchen furniture not before disposed of to them & their heirs for ever. Provided that my son James receive on the general division forty dollars less than the rest of my sons on account of the fifty left to his daughter Lucy. 10 My will is that if my daughter Barbara should die without issue lawfully begotten that her portion should be Equally divided between my sons Robert, Richmond, James, David, & Scott and my Daughter Mary Overton Andrew ------- Charles Cosby 11 My will is that my land should neither be exchanged or rented by my wife without the consent of my Executors. 12 My will is that if it should be found that the portion left each of my sons Richmond, James, David, & Scott be greater that that left my son Robert, then my son Roberts portion to be made equal of the joint portion of my said sons. 13 I give to my son David my gun known by the name of Old Coal. I give to my son Scott my gun known by the name of Danell Morce. 15 My will is that if my daughters or either of them should die without issue then her or their portions to go to my sons Robert, James, Richmond, David & Scott & my daughter Mary Overton Andrew to be equally devided among them. My will is that Estate be not appraised. 17 Lastly I appoint my sons Robert, Richmond, James & Scott Executers of this my last Will & Testament.
