Carter will 1835 Will Book 1830-1835 Pages 501& 502 Elbert Co. Ga. (page 501) State of Georgia ] In the name of god Amen. I John W. Carter being Elbert County ] weak in in body and calling to mind the certainty Of death upon all the human family but being of sound mind and disposing memory do make and ordain this to be my last will and testament. Item 1st My will is that my body be buried in a decent manner. Item 2nd That all my just debts be paid. Item 3rd That the whole of my estate both real and personal (except what will be hereinafter specified) be equally divided between my two half brothers to wit: William Wooddy & Pleasant Wooddy both of the state of Virginia if they both be living and if either be dead then the whole to go to the survivor to them and their heirs forever. Item 4th That twenty five hundred dollars of my Estate be put to Interest, the Interest of which to be paid to or appropriated by my Executors to my Woman Becky annually and that my Executors make application at least to two separate legislators under the most auspicious circumstances for a Bill to mamunit & set free my said Woman Beckey and that in case such Bill pass that she be set free and receive the Interest as above stated annually during her life. Item 5. In case no Bill of manumition shall pass freeing my said Woman Beckey my Will is that my half Brother William Wooddy take charge of her ( B-- and that he further see that the Interest of the twenty five hundred Dollars alluded to in a former item be paid to her or appropriated to her use annually during her life. Item 6th That at the death of the said Woman Beckey the twenty five hundred Dollars at Interest for her use be equally divided between my two half Brothers above named William Wooddy & Pleasant Wooddy. 7th. It is my desire that my half brother, William Woody shall come to Georgia and take charge of his portion of my estate here and live here but should it be otherwise I desire that my Negro Lucy be sold in this state if they chose it and not be removed to the State of Virginia. Item 8th . I do constitute and appoint my half brother William Woody of the state of Virginia and my two friends James Lofton and Robert Hester my Executors to carry into effect this my last will and Testament in whom I have full confidence In Testimony whereof I have unto set my hand and seal this 27 day of January 1835. Cosby And Zachariah Smith witnesses to the foregoing and annexed last will and Testament of John W. Carter, Dec'd and after being duly sworn desposeth and saith that they and each of them saw John W. Carter sign seal and deliver the said foregoing as his last will and Testament on the day it purports to be done, that the said Carter, signed it in the presence of each of us and that each of us signed the same as witnesses in the presence of said Carter and in the presence of each other, and that the time & execution of the same said Carter was of sound mind and disposing Memory Sworn to in open Court this 14th day of March 1835 Isaac N.
