I, JAMES DILLARD, of the county and state aforesaid being in a low state of health but of sound mind and memory and calling to mind the mortality of the body and that it is appointed once for all to die and having some worldly estate desire to dispose of the same in the following way and manner. First, I command my soul to God and my body to be buried in a christian like manner, all my just debts to be paid and I give to my beloved wife SARAH DILLARD the house and plantation whereon I now live together with the whole of the stock of all kinds, the plantation utensils, the kitchen and household furniture except two feather beds and furniture which now belongs to my daughter JANE DILLARD during her natural life also all money or notes that I may have at my death and it is my desire that all my lands except the premises left to my wife should be sold and the money equally divided among all my children (to wit) my son JOHN DILLARD and my daughter NANCY BRAWNER my daughter MARY ALMAND and my daughter SARAH CAMPBELL and my daughter JANE DILLARD my son ISAAC DILLARD my daughter MARTHA SCOTT and my son THOMAS M. DILLARD. It is my desire that my three grandchildren (to wit), JEPHTHA PERIMAN should have five dollars, SARAH E. PERIMAN should have five dollars and JEREMIAH R. PERIMAN should have five dollars each out of my estate. And at the death of my wife SARAH DILLARD the whole of the estate so willed to her should be sold and the money equally divided among all my children. Lastly, I appoint my son ISAAC DILLARD and my son-in-law WILLIAM D. CAMPBELL my executors to this my last will and testament to which I affix my hand and seal this twenty-fifth day of May one Thousand and Eight hundred and thirty-five. his James Dillard X Seal mark In the presence of Robert B. Personally came into open court James Brawner & William Mills two of the witnesses to this within and foregoing will and being sworn saith that they were present and saw JAMES DILLARD sign seal and acknowledge the within instrument of writing as his last will and testament and that they signed the same as witnesses and saw Robert B. Christian sign his name and that they all signed the same in the presence of and at the request of the testator and that they believe the testator was of sound mind and memory at the time of executing the same. James Brawner Additional Comments: The Obituary of JAMES DILLARD appeared in The Christian Index, p. 286, col. 1 on 2 May 1839 and stated that he was 77 years old at his death.
