Fleming and dated 29 Jan 1869 in Elbert Co., GA: "State of Georgia, Elbert County. In the name of God, Amen, I Moses T. Fleming of said State and County being of advanced age but of sound mind and memory knowing that I must shortly depart this life I deem it right and prooper, both as respects my family and myself that I should make a disposition of the property with which a kind Providence has blessed one - I do therefore make this my last Will and Testament hereby revoking and annulling all others by me heretofore made. "First - I direct that my body be buried in a decent manner suitable to my circumstances and condition in life. My soul I trust shall return to the God who gave it as I hope for Salvation through the merits and anonements of the Blessed Lord and Saviour Jesus Christ. Secondly - I desire and direct that all my just debts be paid without delay by my Executor herein after named and appointed. Thirdly - I give bequeath and devise to my beloved wife Mary E. the tract of land whereon I now live, also the tract whereon my son Reese formerly lived both tracts in said State and County aforesaid. I also give and bequeath to my beloved wife the farming utensils used on and belonging to the farms on said gtracts of land, and two horses, all the cows and calves, oxen, hogs, sheep, stock of all kinds and household and kitchen furniture, and my buggy during her life. Said lands to be rented or leased, yearly, for the support of the widow and two minor children, Sarah Frances and Nancy Elizabeth. And that said named minors to have a bed, bedstead and furniture, cow and calf, one chest and shoat. Fourthly - Whenever said named minors become of age said named property to be equally divided between my widow and children, to wit, Mary E., David R., Bertha E.T. - wife of Elbert Nelms, Mary C. wife of J. O. Maxwell, Martha Ann, wife of Lawrence Adams, Samuel D., Lawrence C., Moses G., Sarah Frances And Nancy Elizabeth. Fifthly - And I hereby appoint my son-in-law Jackson O. Maxwell Guardian of the person and property of my said minor daughters Sarah Frances and Nancy Elizabeth. Sixthly - I hereby constitute and appoint my friend George M. Ward and my wife Mary E. Fleming executors of this my last Will and Testament, this January 29, 1869. Moses T. Fleming Seal Signed, sealed, declared and published by Moses T. Fleming as his last Will and Testatment in the presence of us the undersigned who subscribed our names hereto in the presence of said Testator at his special instance and Request and in the presence of each other, this January 29th, 1869. R. C. C. Roebuck, William T. Craft, W. J. J. Teel" The above Will was proved in the Elbert Co. Court of Ordinary on 5 Nov 1877. [Submitters notes: Moses T. Fleming (1800-1877) was married 1st 1827 to Ruth E. Reese; 2nd in 1833 to Theodosia James; 3rd in 1837 to Frances Adams Thornton; 4th in 1861 to Mary E. Strickland. His 3rd wife Frances Adams Thornton (1806-1860), daughter of William Adams and Catherine Mansfield, had married 1st on 23 Oct 1823 to John Thornton, son of Benjamin Thornton, Sr. Frances and John Thornton had children Sarah Smith, Elizabeth E., William T.
