First - I commend my soul to God who gave it and my body to the earth to be buried in a Christian manner. Second - I direct that all my just debts be paid without unnecessary delay. Third - I have given to my daughter Mary M. Rucker two thousand and eighty dollars in property heretofore. Fourth - I have also heretofore given to Joseph Sewell in trust for the sole and separate use of my daughter Louisa S. Almand and her children fourteen hundred dollars. Fifth - I give to Joseph Sewell in trust for the sole and separate use of my daughter Louisa S. Almand during her natural life the sum of one thousand dollars the interest to be appropriated annually to her support and benefit and at her death said sum and any unappropriated interest to belong to her children. Sixth - I give to John H. Jones of Elberton in trust for the sole and separate use of my daughter Mary M. Rucker during her natural life the sum of one thousand dollars, the interest to be appropriated annually to her support and benefit and at her death said sum and any unappropriated interest to belong to her children should she have any but should she die without lineal decendants living at the time of her death then said sum of money to go to and rest in the children of my daughter Louisa. Sixth - I give to John H. Jones of Elberton in trust for the use and benefit of the Methodist Episcopal Church South at Elberton the sum of five hundred dollars to be held by him in trust and the interest appropriated annually as shall be deemed to be for the best interest of said Church The sum of money in the three last items are to be made up out of notes on hand or money due me at my death if there be any. Seventh - Then I give all the remainder of my property and estate to my beloved wife Susan to be held and enjoyed by her during her natural life or widowhood and upon her death or marriage then my Will is that the whole of my property and estate so given to her be divided taking into consideration what has been heretofore or may be hereafter given by me in my lifetime to my two daughters into two equal parts said division to be made as far as practicable without a sale and one half thereof or one equal part I give to Joseph Sewell in trust for the sole and separate use of my daughter Louisa S. Almand during her natural life free from the control of her husband or any future husband and at her death to go to her children. Eighth - The remaining half or one equal part I give to the said John H. Jones in trust for the sole and separate use of my daughter Mary Rucker during her natural life and at her death to go to her children should she have any but should she die without lineal descendant living at the the time of her death then said estate to go to and rest in the children of my daughter Louisa and if any of the children of either of my daughters (should Mary have any) should be dead at the death of their respective mothers leaving issue living at the death of said mothers then the said issue to take the part their deceased parents would have taken under the several items of this Will. I nominate the aid John H. Jones and my beloved wife Susan as Executor and Executrix of this my last Will and Testament. Martin and Robert Hester and being duly sworn saith that they saw Simeon Hall sign and seal the within instrument of writing as his last Will and Testament and that they signed the same as witnesses in the presence of the testator and at his request and in the presence of each other and they believe the testator to have been of sound mind at the time he executed the same to wit on the 4th day of February 1859. " [Submitter's notes: This Simeon Hall was born on 11 Oct 1805, the son of William Hall and Sarah Blake. He was first married on 29 Jul 1828 in Elbert Co. to Lucy Stinchcomb, daughter of Absolom Stinchcomb, Lucy being the mother of the children named in the Will. Simeon remarried on 9 Oct 1851 in Elbert Co. to Susan Brown, and they had one son who died as an infant. This Simeon should not be confused with another Simeon Hall (1831-1911) who was the son of Thomas Hall (brother of the testator above). The younger Simeon married Seleta Elizabeth Brown on 30 Oct 1853 and in 1884 moved from Elbert Co. to Alabama near Rainsville, accompanied by 4 of their 5 children, with son William "Billy" Hall remaining in Elbert Co.] Submitted by: Chandler Eavenson
