Written: 1795 WILL - James Head - 23 Oct 1795 The following Will is recorded in Elbert Co., GA Deed Book A, pages 79-80: "In the name of God amen I James Head of Elbert County in the State of Georgia being sick and weak but in perfect memory thanks be to God for the same, do make and ordain this my last will and testament in manner and form following, Viz, Item I lend and bequeath to my loving wife Elizabeth Janett Head two negroes, Viz one named Wegan and the other named Sarah together with four feather beds and all my household furniture working tools and stock of hogs and cattle and two work horses and I lend my sorrel mare to my wife Elizabeth during her life and the two first colts that the said mare may have the present colt the said mare now has I give to my son Benjamin Simon Head and the next the mare may have I give to my son James Head and the rest of the colts that the said sorrel mare may have to be equally divided amongst all my children - Item. I give and bequeath to my daughter Sarah Fortson one negro girl named Liscy one feather bed and furniture saddle and bridle all now in her possession - Item my will and desire is that my land lying on Vans Creek after the death of my wife be divided between my two sons Benjamin Simon Head and James Head and the remaining part of my property to be divided by my Executors in manner and form following beginning with Martha Head and so down to James Head each of them to have one negro, feather bed furniture and saddle and bridle and after each of them have received one negro, feather bed and furniture and saddle and bridle then the ballance of my estate to be equally divided amongst those of my children from Martha down to James Head. And my tract of land of two hundred acres in Wilkes County on Kettle Creek to be sold by my Executors to pay on just debts and if my wife Elizabeth Janet Head should marry the land and property not willed to my wife to be taken out of her hands, to support the children at the distribution of my Executors - Lastly I do constitute and appoint my loving wife Elizabeth Janet Head Sally Riddle Thomas White my Executors to this my Last Will and Testament NB the increase of the negro woman Sarah willed to my wife to be equally divided among my children at the general distribution and if any of my present surviving children should die without an heir lawfully begotten of their body then their portion to be equally divided amongst those of my children that may be alive. I do hereby make void and disannull all former Wills by me made and acknowledge this to be my Last Will and testament in Witness I have hereunto set my hand and seal this 23 day of October 1795. [Additional Information: James Head was the son of Benjamin Head and Martha Sharman of Orange Co., VA. James, born ca 1753 in Orange Co., married 5 Dec 1775 in Orange Co. to Elizabeth Janet Powell, daughter of Simon Powell and wife Martha. The children of James and Janet Powell Head were: (1) Sarah, married Benjamin Fortson; (2) Martha, married John Lewis; (3) Lucy, married 1st James Allen, married 2nd Peyton Jenkins; (4) Elizabeth, married Reuben White; (5) Benjamin Simon Head; (6) James Head, married 1st Martha Richardson, married 2nd Nancy E.
