February 9, 1790, I Benjamin Higginbotham, of Wilkes County and state of Georgia being in a low and weak state of body but of perfect mind and memory, thanks be to God and calling to mind the mortality of my body and knowing that it was appointed for all men once to die, I recommend my soul into the hands of god that gave it and my body to earth to be buried at the discretion of my executors, nothing doubted but at the general resurrection that I shall receive the same by the mighty power of God and as touching such worldly estate wherewith it hath pleased God to bless you in this life I give and dispose of the same in the following manner and form . Impremis I lend to my beloved wife, Elizabeth Higginbotham four negroes, namely, Joe, Will, Anne and Jude and increase of Anne and Jude and the Household furniture that I don't dispose of otherwise in my will and my stock of cattle and hogs and the crop that is then on hand . During her natural life making no waste or spoil of the same and her death to be equally divided amongst my children to them and their heirs forever. Item: I give to my daughter, Ann Higginbotham, one negro wench named Lucy and her increase to her heirs forever, also one negro named Hunpry to her and her heirs forever. Item: I give to my son, Caleb higginbotham, one negro named Jack to him and his heirs forever. Item: I give to my son, Benjamin Higginbotham, one negro wench named Charity her and her increase to him and his heirs forever. Item: I give to my son, Joseph Higginbotham, one negro wench named Phillis her and her increase to him and his heirs forever. Also the land that I hold now to be equally divided between son Joseph and Francis, if my son Joseph should decease without an heir lawfully begotten then what I have left to him be equally divided amongst his brothers and sister. Item: I give to my son Francis Higginbotham, one negro wench named Rachel her and her increase to him and his heirs forever, also the land that I now own to be equally divided between my sons Francis and Joseph. My sons William, Benjamin, Joseph and Francis, I make and ordain with my beloved wife Elizabeth Higginbotham, my sole executors and executrix of this my last will and testament, and I hereby revoke and disanul all and every other former testament, wills, requests, and executors by me in any wise before this time named. Ratifying this and no other to be my last will and testament. In witness whereunto I have unto set my hand in seal.
