I, Daniel T. Higginbotham of said State and county being diseased and may shortly depart this life, deem it right and proper both as respects myself and family, that I should make a disposition of the property with which a kind Providence has blessed me - I do therefore make this my last Will and Testament, hereby revoking all others by me hitherto made. First - I desire and direct that my body be buried in a Christian like manner, decent and suitable to my circumstances and condition in life. My soul I trust shall return to rest with God who gave it, as I hope for Salvation through the merits and atonement of the Blessed Lord and Saviour Jesus Christ. Secondly - I desire and direct that all my just debts be paid by my Executors hereinafter named and appointed. Thirdly - I give, bequeath and devise to my beloved wife Emma Eugenia Higginbotham my entire property, consisting in Lands, Stock, Farming utensils, House furniture, Notes and Acct. and anything else whatever belonging to me, during her life and then to be equally divided among my children Ida E., Beatrus L., Rufus E. A., Ealer A. and Leler D. Higginbotham to have and use to their own benefit and use. Also that D. R. Higginbotham come and live on my land with my family, provided him and my wife can agree concerning the terms. I hereby constitute and appoint my Emma E. Higginbotham Executrix and E. B. Higginbotham Exr of this my last Will and Testament this 27th May 1876. Daniel T. Higginbotham Seal "Signed, sealed, declared and published by Daniel T. Higginbotham as his last Will and Testament in the presence of us the undersigned, who subscribed our names heeto in the presence of said Testator at his special instance and request, and in the presence of each other. George (x his mark) Eavenson, J. O. Maxwell, L. M. Adams, J. A. Harper." The above Will was proved on 5 June 1876 by Judge A. Harper, one of the subscribing witnesses, before James A. Andrew, Ordinary, and recorded on 8 Jun 1876. [Submitter's notes: Daniel T.
