This file was contributed by: Barbara Walker Winge barbarawinge@yahoo.com ==================================================================== In the Name of God Amen I John Johnson of the State of Georgia and County of Elbert, being Weak in person, though through the Mercy of Almighty God of perfect Sense mind and Memory thanks be to God for his Mercies Calling to mind the Mortality of the Body and knowing That it is appointed for all men once to die, do make and ordain this my Last Will and Testament and therefore I first Recommend my Soul to Almighty God who gave it and my Body to the Earth to Be Buried in a Christian Manner by my Executors No thing doubting but at the Great Resurrection I Shall Receive the Same again by the Mighty Power of God - - - And as touching Such Worldly Estate Wherewith it has Pleased Almighty God to Bless me in this Life I do hereby give demise and dispose of it in the Following Manner Viz - - - First I bequeath to my well Beloved Wife Catherine and to my Son Angus and to my three daughters, Mary Elizabeth and Nancy all and singular my Moveable Property of what Nature or Kind Whatever Except what I shall hereafter otherwise – dispose of in this my Last Will and testament. Said property to be Equally divided amongst those who may Live of My aforesaid Wife and four Children. Should any or Either of them die, But to be kept together for the Support of My Wife and four Children aforesaid. During My Said Wifes Lifetime and then to be Justly Proportioned to Each of My Afore Mentioned Children By my Executors - - - I Give and Bequeath to my aforesaid Son Angus the tract of Land whereon I now Live Reserving the use and Benefit of Said Lane to my Wife During Her Life time But Should my Said Wife died before my Said Son Angus Comes of age then the use and Benefit of Said Land Shall be applied by my Executors in Raising and supporting of My afore mentioned Children until Such time as Angus of age .3d.y I Give and Bequeath to my aforesaid Son Angus fifty dollars to have out of my Moveable Property by my Executors when he comes of age _______________________________ 4th I Give and Bequeath to my Wife Catherine and four Children (97) Agnus Mary Elizabeth and Nancy a certain Negro Girl now in my Possession Named Jenny her and her Service and Increase During her or their Life. Also I Give and Bequeath to My aforesaid Mentioned Wife Catherine and four Children Angus Mary Elizabeth and Nancy A certain Negro Boy now in my Possession Named Frank and Said two Negroes there here and Increase to be applied in the Supporting of my Said Wife and four Children - During my Wifes Lifetime and then to be Eaually divided between my Said four Children by my Executors - - - 5th I Give and Bequeath to my four Sons Donald John Malcolm and Neil a certain Negro Woman now in my Possession Named Leeza her and her Increase to be delivered to them two years after my demise if She Is alive - - - 5th Be it Remembered that I have already given to my two Sons - Alexander and Peter all that I intend them or Either of them to have of My Estate therefore Exclude them and each of them – from any Claim To my Present Estate other tan one shilling Sterling to Each of them to Be paid by my Executors to Each of them - - - Lastly I Nominate and Ordain my two Brothers in Law Angus Johnson And Archibald Johnson the Sole Exeuctors of this my Last Will and Testament Rattifying and Confirming the Same and Every part thereof To be my Last Will and testament in Witness Where of I have hereunto Set my hand and Seal this 13th Day of March 1802 _____________________ Sealed Signed and acknowledged his In presence of ___________________ John Johnson mark* H Morrison Recorded this Will the _____ Rock 5th Day of August 1802 H Higginbotham C.C.O. *(John Johnson's mark was two straight up and down [vertical lines) lines with a top and bottom line on each one as well as a short line in the middle (Submitted by Barbara Walker Winge, barbarawinge@yahoo.com)
